Trial date set

The trial date has been set for the Essequibo woman Bibi Safora Salim, who is charged for using Facebook to issue threatening and derogatory statements against President David Granger.

The date was set by Chief Magistrate Ann McLennan when Salim, who was charged for attempting to excite

hostility on the grounds of race contrary to Section 2 (1) (C) of the Racial Hostility Act, Chapter 23:01 of the Criminal Offences Act, appeared in the Georgetown Magistrates’ Courts. The trial has been set for June 15, 2016.

In April 2016, Salim pleaded not guilty to the charge and was placed on $200,000 bail.

The 52-year-old mother of three, who hails from Vergenoegen, East Bank Essequibo, was taken into Police custody for questioning following her Facebook post about shooting the President.

She was represented by Attorney Euclin Gomes, who told the Court that his client was β€œtechnologically challenged”.

This claim was, however, challenged by Police Prosecutor Neville Jeffers who strongly objected to bail and told the Court that Salim admitted in a statement to the Police to being the owner of the laptop from which she used a password to access the said account.

He also objected to bail on the grounds of the serious nature of the offence, threats posed, and the racial remarks that were used on social media against the President.

Salim reportedly sent two photos via whatsapp messenger to her son, which shared similar sentiments.

According to Prosecutor Jeffers, the case files are completed and some 14 witnesses are slated to testify in the trial, which should have commenced since May 11

I can't believe what this poor woman is going through when there are much bigger problems in Guyana that require attention, but yet no one is paying attention to what really matters.

You see when you do not have a history of struggle and a love for money, this is what happens to you.  The people of Richmond Hill al only live fuh who got the biggest house and biggest car and they will lose a who country as they strive for the american carrot.

The intellectuals of Richmond Hill prefer to drink beers and fry shark every night and eat poke cutters and get heart problems like pigs rather than advocate to the UN and the US Government against this emerging situation where freedom of speech is now under threat and I speak specifically to what is happening in Guyana Parliament.

This woman was wrong and she should be fine and sent home.  You do not call for "physical harm" to even a dog puppy on facebook much less a human.  Let us spank her, but what is happening in Parliament is wrong.

Opposition has to question the government and the government has to answer.

If the newspaper reports are to be believed Bib could be charged under the Racial Hostility Act, Chapter 23. Now I don't believe a racial incitement was made. Also the area of jurisdiction - the Internet - and not Guyana (the compute device may be domiciled in the territory of  Guyana and the source IP address may be a Telco's that operate in Guyana), may make it difficult to prosecute. Heck the Donald can say Tweet carpet bomb Syria (including civilians) and no sane person could take him to court.

Even if the above is irrelevant in Guyana one would have to make the case that it rises to the level of treason. If a guy shouts to his 6 friends gathered for a ball game at Parade Ground in Georgetown "F#@k so and so who happens to be the President of Guyana and let's kill he r@$$", should he be tried for treason?

Youth accused of showing middle finger to President gets $5000 High Court bail

Several leading personalities yesterday turned up at the Sparendaam Magistrate’s Court in solidarity with an 18-year-old man who was remanded to prison for two weeks for allegedly showing his middle finger to President Jagdeo’s convoy.
The young man, Kevin Simon of South Ruimveldt, allegedly made the obscene gesture while travelling on the main East Coast Highway on August 8.
He was initially charged with breaching the peace under one section of the law and appeared before Magistrate Judy Latchman the following day and pleaded not guilty.
He was remanded to prison for one week but on his return to court on August 16, he was sent back to the Camp Street Prison for another week.
On those occasions, Simon was unrepresented by counsel.
His family then secured the services of prominent defence attorney Nigel Hughes, who subsequently applied to the High Court and secured bail in the sum of $5,000.

Yesterday, the Prosecution informed the court that they were withdrawing the charge against the young man, with a view to reinstitution under another section of the law.
Ewald Simon, the young man’s father, told this newspaper that when they turned up at the Sparendaam Magistrate’s Court yesterday, they learnt that the matter was already called.
However, a representative who was in the courtroom, related to them that the police had β€œreallocated the charge to another section (of the law), because it couldn’t stand up under the present section and, they will send the youth a summons to appear (in court) on September 20.”
The Prosecution is contending that the young man stuck out his middle finger at the President, which they claimed amounted to a criminal act.
The young man, a porter on a water delivery truck, is on the other hand contending that he was merely hanging his hand against the breeze when he was accused of the act.
He was detained at the Sparendaam Police Station for an entire day and night before being taken to court.
Among those showing their solidarity with the young man were former PNCR Member of Parliament Anthony Vieira, Newspaper Columnist Freddie Kissoon, Social Activist Mark Benschop and Trade Unionists Lincoln Lewis and Norris Witter.

Using the law of comparative reasoning here, several GNI members would be executed for this.

At least 10 of them would be facing the gallows, electric chair or a firing squad.

Did you read the above how the Black kid was penalized,imprisoned for showing the middle finger.

You have it all wrong once again. Actions of the previous PPP governments were introduced by their supporters (Lennox and Bibi) to pretend that those governments were superior because they never resorted to any similar behavior. The case of the boy being arrested for showing his middle finger was highlighted to show that what they are saying is fictitious. It is not being used to explain or excuse any behavior by the current government.

Yeah right!  The kid was charged for just showing his middle finger to BJ and this woman is being charged for calling for the death of a President. Quite a difference. I guess u could say it is comparing apples to oranges. The first was just ridiculous, the second ,there is some grounds for charges to stick or be lessened.

Middle finger case dismissed against teenager


 

After a wait of five months, 18-year-old Kevin Simon, who was charged for waving his middle finger at the convoy of former President Bharrat Jagdeo, had his matter dismissed by Sparendaam Magistrate, Alex Moore.
Simon, who had spent two weeks on remand for the alleged act, appeared relieved as he walked out of the Sparendaam Magistrate’s Court yesterday.

It was the final episode of a matter that had incensed a wide cross-section of the society.
In fact, several leading personalities had turned up at the Sparendaam Magistrate’s Court in solidarity with the 18-year-old accused.

The young man, a porter on a water delivery truck, had on the other hand contended that he was merely hanging his hand against the breeze when he was accused of the act.
