Regarding Sections 106(6) and 106(7) ...

1. Government resigns. =Period=

2. Government then remains in office specifically for the elections to be conducted within three months.

3. Relative to point 2, the then government - a caretaker government - performs also routine functions as are needed.

4. The three month period can only be extended with the approval of, at least, two-thirds of the MPs.

I have to agree here. Either he does not understand the very constitution which he was sworn to uphold or he is wishy washy.

Read 106.7. It clearly states when they have to resign. It’s the only clause which addresses the timeframe for resignation and it’s very clear.

Read 106.7. It clearly states when they have to resign. It’s the only clause which states the timeframe for resignation and it’s very clear.

Ok. So it says that "shall resign if the Government is defeated". Does this mean that there is no timeframe for them to resign? I doubt that this is what the framers of the constitution had in mind. I know your argument would say until an election is held. The government can delay the election for a long time.

There is no need for speculation as to what the framers of the constitution had in mind when they wrote the constitution. That is subjective and can go down several paths depending on who’s doing the dreaming. There is an explicit timeframe for resignation and it’s clearly stated in 106.7. No need for wild speculation.

The government doesn’t have to shut up shop now and go home. They still need to continue running the country. However they need to begin preparing for elections to be held within 90 days from the NCV. What they cannot do during this 90 days window is pass new legislation.
