Roxanne Myers in Police lockup for ‘obstructing the course of justice’- Attorney Hughes

Deputy Chief Elections Officer Roxanne Myers was arrested on Tuesday after she reportedly refused to cooperate with the Guyana Police Force which is currently investigating the March 2, 2020, General and Regional Elections.

“She has been arrested for obstructing the course of justice because she exercised her right to silence,” Attorney Nigel Hughes told the News Room in a telephone interview Tuesday.

According to Hughes, his client learned that she was wanted by the Police for questioning and so she voluntarily visited the Criminal Investigations Department (CID).

He said “[Ms. Myers] was informed today that the Police wanted to interview her, she attended the Police station with her lawyers, when we got there we had a bit of a wait and then they questioned her. She said she wanted to exercise her right to silence and they then said they’re going to keep her in custody on the basis of obstructing the course of justice.”

Hughes told the News Room that “she has been sent to one of the lockups” but he is not sure where his client is being held.

The Guyana Police Force in August announced that it will launch a “comprehensive investigation” into allegations of criminal conduct by Chief Elections Officer (CEO) Keith Lowenfield and Returning Officer of Region Four Clairmont Mingo in relation to the March 2 elections and the events that followed.

Lowenfield and Mingo are already facing criminal charges in the Georgetown Magistrate’s Court relating to fraud, misconduct in office and breach of the public’s trust by providing results of the March 2 elections known to be false.

The officials who remain, employees of GECOM, are accused of providing fraudulent results of the elections in the largest voting district –Region Four –following the close of polls, to give the APNU+AFC a victory.

This led to a delay in the declaration of the results of the election and a national vote recount before the People’s Progressive Party was declared the winner of the elections five months later.

Mingo is also before the court with Chairman of the People’s National Congress Reform –the largest party in the Coalition –Volda Lawrence on another fraud charge. Their signatures were found on one of the Region Four declarations which was found to be inflated in favour of her party.

Mingo and Lawrence’s case continues on November 16. 

As the investigation is ongoing, the Police previously questioned GECOM’s Information Technology Officer Enrique Livan who was involved in what is known as “the flash drive scandal” during the electoral process and other employees of the elections body.

Has she been charged?  What illegal behaviour?  Nigel Hughes is the real deal--he's going to smack the PPP mobster lawyers around.

The same Nigel Hughes of the infamous 34 is the majority of a 65 persons assembly whose argument got smacked by the PPP lawyers as well as the CCJ judges. When Nigel Hughes is the best one has it explains why the Coalition lost every legal case since 2018.

Nigel Hughes did not argue the NCM case or any of the elections related cases at any level.

The PNC lawyers are bullies.  Mingo, Lowenfield, Myers, and others must pay for their crimes.

Police Force rejects Nigel Hughes’ statements that Roxanne Myers arrested for ‘remaining silent’

The Guyana Police Force has rejected the statements attributed to Attorney at Law Nigel Hughes in which he claims that his client – Guyana Elections Commission (GECOM) Deputy Chief Executive Officer Roxanne Myers – was arrested and detained because she exercised her right to remain silent.

The Police, through Public Relations Officer Assistant Commissioner Royston Andries-Junor, said that Hughes’ statement is a distortion of the truth.

Myers was arrested on October 6 after she turned herself in at the Criminal Investigations Department Head Quarters, Eve Leary, Georgetown in the company of her Attorneys one of whom was Hughes.

The Force said that Myers surrendered after they have been actively pursuing her for over a month and even attempted to contact her at her GECOM Office. She was being sought in relation to the events following the March 02 General and Regional Elections.

However, those efforts were futile as Myers made every effort to elude the Police investigators. As a consequence, a wanted bulletin for Myers was prepared by the GPF but before it was issued, she turned up at CID Headquarters in the company of her Attorneys where she surrendered to the Police.

Further, Myers was promptly arrested for the offence of conspiracy to defraud and she was told of the allegation at the said time. She then exercised her right to remain silent.

Myers remains in police custody as the investigation continues into her actions during the post-March 2 elections incidents is ongoing.

Is this a police state being consolidated?  Can someone be detained without charges?  For how long? The PPP will not be able to deal with the backlash of all this.

Volda single handedly save koolie from being slaughtered and this is the thanks that she get. These Jaganites led by Anil are real sho_ts. They really believe that paid African enforcers will protect them. My only concern is that the poor East Indian people who cannot afford to pay for armed African security, guns, ammunition and explosives will pay the price with their blood.

Roxanne Myers electoral fraud cases to continue on Aug 3

The electoral fraud cases against Guyana Elections Commission (GECOM) Deputy Chief Elections Officer Roxanne Myers will continue on August 3, 2021, when the matters are set to be called for reports before Senior Magistrate Leron Daly at the Georgetown Magistrates’ Courts.

In February last, Magistrate Daly ruled that a Preliminary Inquiry (PI) would be conducted into the two counts of misconduct in public office against Myers. This means that the presiding Magistrate will now conduct a PI to determine whether there is sufficient evidence to commit Myers to stand trial at the High Court.

It is alleged that between March 4 and 14, 2020, at High and Cowan Streets, Kingston, Georgetown, while being a public officer, that is to say, the Deputy Chief Elections Officer of the GECOM, Myers wilfully misconducted herself together with Region Four Returning Officer Clairmont Mingo and others, to declare a fraudulent account of votes for the Regional and General Elections of the March 2, 2020 General and Regional Elections, the said misconduct amounting to a breach of the public’s trust in the office of the said Returning Officer for District Four of GECOM, without any reasonable excuse or justification.

Myers has not been required to plead to the indictable charges. She was released on $300,000 bail.

The Director of Public Prosecutions (DPP) has hired a team of special prosecutors to prosecute the electoral fraud cases against Chief Elections Officer (CEO) Keith Lowenfield, DCEO Myers, Mingo, GECOM clerks Denise Bob-Cummings and Michelle Miller, GECOM Elections Officer Shefern February and Information Technology Officer Enrique Livan, APNU/AFC activist Carol Joseph, and People’s National Congress Reform (PNCR) Chairperson and former Public Health Minister Volda Lawrence.

The more than 25 matters are currently before three Magistrates – Chief Magistrate Ann McLennan and Magistrates Sherdel Isaacs-Marcus and Leron Daly. Lowenfield’s report claimed that the APNU/AFC coalition garnered 171,825 votes while the PPP/C gained 166,343 votes.

How he arrived at those figures is still unknown. The certified results from the recount exercise supervised by GECOM and a high-level team from the Caribbean Community (Caricom) pellucidly showed that the PPP/C won with 233,336 votes while the coalition garnered 217,920.

The recount exercise also proved that Mingo heavily inflated the figures in Region Four – Guyana’s largest voting District – in favour of the then caretaker APNU/AFC regime.
