President cannot call elections unless authorized by Parliament

 
 

Dear Editor:
This nation is fast descending to a state of madness by some of those we have entrusted the responsibility to lead us.
1. An illegal government or illegal president cannot make any legal decision;
2. The President in the present circumstance cannot call date for election unless so authorized by the National Assembly as per Article 106(7) in the Constitution;
3. The “three months” period where the President could have named a date for election without the approval of the National Assembly expired in March;
4. Even if the President were to prorogue the House, such prorogation would only be lawful after approval of members of the National Assembly to extend the time when an election can be held;

The President David Granger situation is different to that of Donald Ramotar. Ramotar in seeking to avert a no-confidence vote, avoided the House sitting, then moved to prorogation and announced a date for the election. In Granger’s case, a vote was allowed and passed, followed by litigation that saw the initial timeframe -i.e. three months- when an election could be held ran out. So, in order for President Granger to prorogue the House and announce a date for an election, according to the law- i.e. Article 106(7)-the House has to sit and grant him the authority to extend the time for election beyond the “three months.”
5. It should be of interest or serve as a grounding point to recall acting Chief Justice Roxane George-Wiltshire’s SC pronouncement on 2nd August in hearing the Fixed Date Application Case for the holding of an election;

Kaieteur News, 3rd August 2019, in an article titled, ‘Election date long gone- Chief Justice,’ reported that “Based on her understanding of the judgment and consequential orders by the Caribbean Court of Justice (CCJ), Chief Justice Roxane George yesterday said that the date for general and regional elections, March 21, has long gone. In fact, Justice George noted that ‘we’ are supposedly in a period of an extension for the timeframe for holding elections, but that extension has not been agreed on. We are still waiting on the National Assembly to meet.”

6. The Opposition Members of Parliament (MPs) who are refusing to return to the National Assembly and carry out their responsibility are not only engaging in an act of lawlessness but also holding this nation and our system of governance to ransom. It should be noted for such lawless conduct they continue to receive monthly salary as MPs and daily benefits/privileges that come with their office.

Never before has this nation witnessed where the need arises for parliamentary support of the Opposition to give effect to any act, that side of the House has abrogated its responsibility by withholding its vote. For six months and counting the nation continues to be held hostage to this conduct by the very people who are shouting they want the Constitution to be upheld. If they really care about Guyana, knowing that they hold the other part of the equation in their hands, they would return to the National Assembly and do the job they are being paid for.

The continuous media brawl, bullying tactics, constitutional and court misrepresentation remain threats to resolving issues in a lawful and orderly manner, doing more harm than good to the nation and her people. Our laws must be upheld and the seeming support for this new low in lawlessness, by internal and external forces, if not corrected now will haunt this country forever.

Lewis has now descended to a new low with the nonsense he wrote above. He should have been as forceful in his observations of Granger and the Coalition behavior over the past nine months. He can’t even pretend he didn’t realize that the wickedness of the Coalition was going to place Guyana in this position because everyone and their uncles have been saying that Granger is headed for a constitutional crisis. Not missed in his commentary is his parroting of Granger’s comments. Noticeably is his swipe at the diplomats’ reprimand from last week. The PPP had said back in December that they will only return to parliament to discuss elections. The wicked Coalition put their wickedness before the interest of Guyana and marched to the constitutional crisis that now exists. This jackass Lewis should go chastise Granger but my bet is his black mentality kicked in so he doesn’t have any shame.

Despite his subtle critique of the coalition, Lewis will continue to support the coalition. The battle lines are crossed in Guyana.

However, Granger is not stupid. He will box the PPP in a corner, saying that the PPP will have to cooperate and allow the budget to budget for the elections, etc. To that end, he will place the onus on the PPP for being obstructionist and unwilling to ensure an early election date. GECOM will ask for more funds, etc.

The PPP will return to parliament to provide the 2/3 majority. Jagdeo will do a somersault and he will defend this sew-saw as a necessary fiat to ensure that the elections are held at the time Granger wants it to be held.

AND, all of this will not matter to the PNC because they have nothing to loose....and their PLAN B is already in place....

Guyana don't need tribalism , the country belongs to all the people. The two major ethnic groups aren't  innocent .

All this is a legacy of Jackass Jagan. Jagdeo did kick them in the nuts that’s why they hate him. But he made his errors. 

The institutions of torture remains fully in the hands of the PNC so it did not take then long to reconstitute Burnhamism!

I don’t see Guyana in much positive terms for either Indians or Blacks.  Oil will just increase the stakes for all parties. Everyone will be gnawing at the edges even more so!  The Americans will hold it together as long as oil is a factor.  When that has crested, they on their own again!

In the end there is a large swath of the population who feel the other does not have equal status and are mere occupiers or squatters.  The Indians are welcome to stay but mind their manners and stay in their lanes.  The Indians feel differently and so you have it!

The only ethnic group that is violating the constitution is the mostly black PNC. Until that is strongly condemned one cannot pretend to be impartial by seeking to shift the burden to the mostly Indian PPP.

Granger greeted with protest in Essequibo

 

Hundreds of citizens on the Essequibo Coast, Region Two (Pomeroom/Supernaam) earlier today picketed President David as he made his way from the Hampton Court airstrip to attend a function in Queenstown.

The protestors have called for the Government to resign and for the president to set a date for regional and national elections.  Some of the protestors also picked State House, in Anna Regina calling for Granger to respect the constitution.

The peaceful gathering included PPP Executives Leslie Ramsammy, Nigel Dharamlall, Vishnu Samaroo, Regional Chairman Davanand Ramdatt and Peter Ramsaroop.

The protesters have accused the APNU/AFC Government of failing the nation.
