The Guyana Police Force (GPF) has been granted Orders authorizing the deportation of 26 Haitian nationals who have been detained for weeks at the state-run Hugo Chavez Centre for Rehabilitation and Reintegration.

The individuals are to be deported for allegedly lying about where they would be staying during their visit to Guyana.

According to Attorney Darren Wade, who has been representing the interest of the detained immigrants, the action is “arbitrary” and was conducted with a clear disregard to his clients’ rights to Natural Justice.

“They were not inform-ed of, nor allowed to respond to the charge. There is no evidence I have seen supporting the contention made in the applications,” he told Stabroek News yesterday in an invited comment.

Based on documents seen by this newspaper Principal Magistrate Sherdel Isaacs-Marcus granted several November 30 applications from Assistant Superintendent of Police Troy Benn of the Central Immigration Office. The applications called for the nationals to be removed from Guyana and “in the meanwhile be detained in custody”.

One application contends that on presenting himself to the immigration officers at the point of entry the Haitian national “failed to answer truthfully a question posed by the immigration officer in that there was a false representation of where he was staying, in contravention of Section 9(1) (a) of the Immigration Act” consequently by virtue of Section 9(2) he has been deemed a “Prohibited Immigrant.”

The application itself has been brought to the Magistrate’s Court under the aegis of the Section 28 of the Act which specifies that any magistrate may on the application of an immigration officer order a prohibited immigrant to be removed from Guyana.

Notably Section 28 directs that where such an Order is made the prohibited immigrant is to be removed from Guyana ‘at such time and in such manner as the Chief Immigration Officer shall direct”. The Officer is however asked to “have regard” to several conditions including the country of which the immigrant is a subject and the wishes and means of that immigrant.

The applications were made on the same day that Wade approached the High Court to have the 26 persons including seven children released from “protective custody”.

The Ministry of Home Affairs announced last week that the Haitian nationals were found after the police conducted two search-and-cordon exercises in Georgetown and Region Ten.

Some of the Haitian nationals were discovered in a city hotel while others were found in a minibus on the Linden-Mabura road. Among those found were seven children, two boys and five girls.

According to a ministry statement, the discovery was made as part of an investigation into a suspected human smuggling racket and trafficking in persons ring.

The Haitians have however denied any involvement in  trafficking.

Wade in presenting their case before Justice Priya Sewnarine-Beharry argued that since those detained had committed no crime or been accused of committing any crime their detention was illegal.

The Attorney General who was represented by Prithima Kissoon is said to have disclosed to the judge that the Haitians were being kept in custody for deportation.

Stabroek News had reported same on November 13.

This is bull crap ,travelers to a country are denied entry and then deported.They aren't given entry then hunted down for deportation.

Haiti is part of Caricom ,what happen to their traveling rights ?

This PPP regime is a nasty racist group.  Let the people go.  Imagine for a moment that those Haitians were IndoTrinidadians or Indians from Mumbai:  they would have brought out malas to welcome them.

Haiti became the Caribbean Community's newest member on 2 July 2002 some four years after provisional membership had been granted.

In 2011, when Jamaican  Shanique Myrie accused Barbados immigration officers of sexually assaulting her in detention at Barbados airport and it went to the CCJ.  Barbados was found guilty with a hefty fine, not only because of the sexual assault, but because she was deported as a member of a CARICOM nation. Just like the Haitians in Guyana, who might have legal rights in the courts.
The Myrie story severely affected tourism in Barbados, when groups of seniors found other countries to spend their vacation funds.

Most Indo Guyanese when returning home for a visit would lie and say that they will be staying at a hotel. Dem nah want dem black man at de airport to know dem real place of stay for security reasons or not to endanger the lives of their relatives who would be hosting them.

These Haitians rights are being violated.

The Haitians  should hire the same Jamaican lawyers for a percentage of the settlement and take the PPP government to the CCJ.

Whether its a project or an action, the PPP use their little brain do things, but spend enormous amount to get out of it. Could it be because they all graduated from Pauling Front University ??

The citizenship act should be changed to ensure Guyanese remain in control of the country.  Citizenship should only be granted if at least one of your great grandparents was a Guyanese citizen and it should be retroactive from the first day of independent Guyana.

I am no fan of Jaganites. I hate Jaganites so much that I can taste it even when I eat Mrs. Prashad's delicious beef cook up rice.  They are only good to receive the lead.  I like President Jagdeo.  His common-law wife what has been with him for many years is a black woman.  So I don't know which PPP cronies that you are talking about.

Too many illegals and fakes in Guyana running around undetected.   Dr Jagdeo was so right to disband fake healers. The PPP has to do what is reght for his people, Guyanese were taken for a ride too long, BS has to stop.

Yes there is....Exhibit 1...Irfaan Ali's degree form UWCD.  I have no idea why anyone is denying what has been established as fact,  leaked by his own comrades wo knew about it.  The president has a degree from a university that does not exist.  Fred Sukhdeo had it printed for him.  He then sent that to India to get admitted to some fly by night university to get a scholarship that was offered to the government.  Ask Nanda Gopaul, he knows about all this.

Jagdeo should not be called Dr.  He has an honorary doctorate .  People with those don't run around calling themselves Dr.  How many times do you have to be told this?

It's not Jagdeo calling himself that, it's his sheep trying to build him up as someone better than they...and that is quite alright by me if those folk see themselves as nothing's.

He doesn't call himself a doctor. I recognize that he is a Dr. Why  grant him an honoray  doctorate only if he worth such. The Champion of the Earth. Must admit  he is well liked by the people and will be a subject of your conversation for a long time.

No country wants to have suspected human traffickers or illegals in their country. One has to ask why are the Haitians here, and when did they come in. Every country has to protect its borders and citizens.

Guyanese have been given a bad rap throughout the Caribbean for years and were treated like pariahs. Now people want to get into Guyana by whatever means given the potential wealth of the country.

This problem was caused by the coalition which was planning to use the Haitians to bolster their vote bank. Granger created the Citizenship Ministry for that reason.

The court has ruled....they should be released, then DEPORTED.

So, let me ask....the US has signed on to many international law an agreements. Do they have to, and have they always acted on the basis of those laws.

You must have gone to the same school of Irfaan. Signing on to regional and international agreements does take away a country's independence, and a country must act to protect its national borders and interests.

You chaps like to make this into a racial think, but its not. The court has ruled. Guyana is a country of laws, I think.

Try doing this nonsense in another CARICOM country and see what happen to you...try going to Barbados, Jamaica, or Haiti. If you cant explain why you are going there, you will be barred from entry, much less being found in the country and not being able to explain how you got it.

Brainless man, it is a known fact that the Haitians are using Guyana to get to French Guiana via Suriname and then from there some are able to come to Montreal and France.

whether they come to Canada or France is not the issue. Who cares where they are going? They are caught in Guyana. If you come to the US under those conditions we will deport you rass too.

Keyboard malfunction- That should have read "NOT" give up their independence. This is even more of a reason why Guyana has to control its borders. I still say deport them.
