At first glance it would seem that way but the words "as provided for" are what make the difference and gave Granger an avenue out.

We can see that some of the names mentioned on Jagdeo's list were frivolous or even disrespectful.  Not to say that all were but please don't fool yourself that Jagdeo didn't deliberately plan to provoke a crisis.

You need to stop looking for what a rational constitution would have, with checks and balances and understand that this constitution replaced a prior one. This constitution was to ensure that control remained within the soul domain of the president.

So Granger can say that he doesn't find the names submitted to be suitable. Has no obligation to say why. He can then move on to make his own unilateral decision.

In 1992 Guyanese were told that one of the first actions of the PPP was to change the constitution. 23 years later they did NOTHING, because they too liked concentration of power in the hands of the president.

The PPP just couldn't imagine a scenario where they would lose an election, given the ethnic demographics of Guyana.  They didn't predict the implosion of the Indian population and a rapidly expanding mixed identified population, so a constitution giving outsized power to the president was to their liking.

Well Burnham did NOT intend anyone to head GECOM unless it was someone who he approved of and he deliberately put in place mechanisms to ensure that if the opposition didn't submit someone to his liking that he would have an alternate!

I remember D2 used to insist that the PPP adjust to the fact that shifting ethnic demographics increased the probability of an electoral loss.   He insisted that the constitution be changed.

He was dismissed as an anti Indian racist amidst screams of "ahbe pan tap...cooolie man time now.....black man time done....blackman will never be president again".

Burnham has absolutely nothing to do with the formation of GECOM.

Guyana Elections Commission (GECOM)

The Guyana Elections Commission (GECOM) is the entity that is responsible for the administration and conduct of elections in Guyana. GECOM is headed by a Chairman and six Commissioners. GECOM is supported by core staff in its Secretariat. The work of the Commission is supplemented in its elections preparation and administration by thousands of temporary staff.

Issues Related to the Evolution of GECOM:
Prior to 1991, the Elections Commission was comprised of a Chairman who was appointed by the President and one member in respect of each political party, including the governmental party, which had not less than five seats in the National Assembly. The Chairman of this Elections Commission had to be a person who at the time was holding or had held office as a Judge of a Court having unlimited jurisdiction in civil and criminal matters in some part of the Commonwealth or a court having jurisdiction in appeals from any such court or who is qualified to be appointed as any such Judge. This Commission had a temporary life in that a member had to vacate office within three months of the date of the election for which he/she was appointed to be a commissioner. [See Article 161, Constitution of Guyana 1980.]

Electoral reform in Guyana started in 1990 and continued throughout the period preceding the 2001 General and Regional elections. During this process, the composition of the commission was changed in time for the management of the 1992 general elections. For the 1992 and 1997 elections, the Elections Commission was still a temporary institution constituted for each election. For example the Commission established by virtue of the Constitution Amendment Act No. 15 of 1995 had a limited life in that it only existed between the 12th December 1995 and the date of expiry of three months after the date of the General Elections of December 15, 1997.

The present GECOM was established in May 2000 by virtue of the Constitution (Amendment) Act No. 2 of 2000, which repealed and re-enacted article 161 of the Constitution on the basis of recommendations emerging from the Constitution Reform Commission that were ratified by Parliament. The re-enacted article 161 re-states the same mechanism for the appointment of the Commission as provided for since the 1992 general election but the Commission is now established as a permanent one. There is as yet no provision for a time limit or the period that commissioners are to serve. All of the powers which were previously exercised by or on behalf of the Minister responsible for the preparation for and administration of elections are now vested in the Commission.

    7. If, by reason of his illness, absence from Guyana, or suspension under article 225, the Chairman or any other member of the Elections Commission is unable to perform his functions as such, a temporary Chairman or other member, as the case may be, may be appointed in his place.
    8. The provisions of this article shall apply in relation to the appointment of a temporary Chairman or other member of the Elections Commission, and to a temporary Chai rman or other member appointed in accordance with this article, as they apply in relation to the Chairman or other member, as the case may be, of the Elections Commission in whose place he is appointed:

This is the relevant clause from the Constitution. Read it as a whole and stop picking out one line at a time.

The Chairman is appointed from a list of six persons 

who are not unacceptable to the president and

who are submitted by the Leader of the Opposition and

after the relevant consultations.

If the list does not meet all the requirements, then the President has the option to choose his judge unilaterally. Granger found the lists unacceptable so he exercised his right, guaranteed by the Constitution, to unilaterally appoint the judge as the chairman.

Stupid questions do not deserve an answer. Granger acted according to the laws set out in the Constitution. He has no obligation to satisfy you or the rest of your porter buddies.
