as trial of US Senator begins

New York – After a four-month delay, the trial of State Senator John Sampson kicked off Monday with the jury selection process. Sampson faces charges related to an alleged embezzlement scheme in which prosecutors say he misused funds entrusted to him as a lawyer in foreclosure proceedings to fund a failed political campaign.

 

 

 Though he has escaped embezzlement charges on a statute of limitations argument, he is still accused of attempting to conceal money that he allegedly stole.

 

Sampson was first arrested and accused of embezzling approximately $400,000 in 2012, having allegedly used the funds from the sale of foreclosed homes to fund a bid for district attorney in 2005, according to reports.

 

While the judge tossed out those charges due to time limitations, Sampson still faces nine counts including obstruction of justice, witness and evidence tampering, concealment of records and making false statements to law enforcement officers, the Wall Street Journal reports.

 

To replace the funds, Sampson allegedly borrowed money from real estate broker, Guyanese-born Edul Ahmad, who himself was charged in July 2012 and pleaded guilty to mortgage fraud.

 

Prosecutors say Sampson ordered Ahmad

to destroy evidence upon his arrest.

 

The Daily News reports that Ahmad pressed Sampson

for political favours when he failed to repay the loan.

 

Ahmad is being called as a witness for the prosecution,

and secretly taped Sampson for investigators.

 

Sampson is also accused of witness tampering,

having allegedly requested the prosecution’s witness list from

a friend in the U.S. attorney’s office.

 

 

 

 

The prosecution claims Sampson said

he wanted the list so he could “take them out.”

 

The senator, who represents a broad swath of Sheepshead Bay connected by a one-block-wide stretch to his home base of Canarsie and East New York, found himself in hot water again last week when he was rebuked by the judge for attempting to contact Assemblywoman Shelley Mayer, who is expected to testify at his trial.

 

Opening arguments will be presented tomorrow. Sampson faces 20 years in prison if found guilty. He pleaded not guilty. (SheepsheadBites.com)

‘thought he was above the law’ – Prosecutor

(New York (New York Daily News) -Brooklyn state Sen. John Sampson is a corrupt lawyer and lawmaker “who thought he was above the law,” a federal prosecutor said Wednesday.

 

 

Sampson is charged in a nine-count indictment with trying to cover up his alleged embezzlement of funds related to outside legal work.

“He stole hundreds of thousands of dollars and when he thought he was going to get caught, he lied and tried to obstruct justice to get away with his crimes,” Assistant U.S. Attorney Marisa Seifan said in her opening statement in Brooklyn Federal Court.

 

When Sampson became concerned that the funds he allegedly embezzled from foreclosure accounts as a court-appointed referee was going to be discovered, “he doubled down and committed new crimes to cover up the old ones,” Seifan told the jury.

 

Although Sampson is not charged with embezzlement or bribery, the Prosecutor contended that he had committed both crimes.

 

The government’s chief witness, Edul Ahmad, will testify that he loaned Sampson $188,500 to partially cover the theft of funds, and was repaid with political favors.

 

Ahmad, a former cop in Guyana and Queens real estate businessman who has pleaded guilty to mortgage fraud, secretly taped Sampson instructing him to keep the loan a secret, Seifan said.

 

In his zeal to find out who might be ratting out Ahmad or himself to the feds, Sampson’s “fatal mistake” was not knowing that the FBI had flipped Ahmad, Seifan said.

 

Sampson is also charged with allegedly lying to FBI agents and trying to weasel confidential information about the federal probe from a childhood friend, Sam Noel, who was a paralegal in the Brooklyn U.S. Attorney’s office.

 

Noel was arrested and will testify against Sampson.

 

Defence lawyer Nick Akerman vigorously pushed back at the government, conceding that Sampson committed some “ethical lapses” but no federal crimes.

 

Akerman argued that his client was entrapped by Ahmad at the government’s direction and “many reasonable doubts lurk in the evidence.”

 

“Even though the government is going to insist John Sampson is corrupt, the reality is, there are no political corruption charges…even though the government wishes that there were.”

 

Sampson faces up to 20 years in prison if he is convicted.

 

Akerman also prepared the jurors for an inflammatory statement they may hear from Ahmad about a suggestion to get rid of snitches.

 

The lawyer emphatically noted that Sampson laughed and replied,

“We ain’t killing nobody! What are you talking about?”

Ed Ahmad begins testimony

against New York State Senator

New York-based Guyanese Ed Ahmad yesterday testified in a Brooklyn Federal Court against NY state senator John Sampson and stated how he loaned money in return for political favours.

 

Ahmad, a convicted mortgage fraudster

who is awaiting sentencing

has been described as the star witness in the case.

 

Sampson is before the court in a nine-count indictment with trying to cover up his alleged embezzlement of funds related to outside legal work.

 

 

“He stole hundreds of thousands of dollars and when he thought he was going to get caught, he lied and tried to obstruct justice to get away with his crimes,” Assistant U.S. Attorney Marisa Seifan said in her opening statement in Brooklyn Federal Court,

 

according to the New York Daily News.

Ahmad, testified yesterday

that that he loaned Sampson US$188,500

to partially cover the theft of funds,

and was repaid with political favours.

 

 

“The Lamborghini-driving Ahmad

— a former cop in Guyana

and real estate businessman

who has pleaded guilty to mortgage fraud —

forged a romance with Sampson

with an eye on the influential Democrat

helping him in his own businesses”, the report said.

 

 

It added

“Sampson glommed free trips

to Antigua and Guyana with Ahmad

where they attended cricket matches,

and Ahmad always picked up the tab

when they dined at fancy restaurants, he testified”.

 

 

Ahmad also testified that

he donated tens of thousands of dollars

to Sampson’s failed run for Brooklyn district attorney

and his re-election campaigns.

 

“I thought if I didn’t give him the loan

it could potentially strain our relationship

and prevent him from helping me in the future,”

Ahmad said on the stand.

 

 

The Daily News report said that

after Ahmad was busted by the feds in 2011,

he agreed to make secret recordings

of Sampson instructing him

to keep the loan a secret,

Seifan said.

 

 

 

Sampson is also charged

with allegedly lying to FBI agents

and trying to gain confidential information

about the federal probe from a childhood friend,

Sam Noel, who was a paralegal

in the Brooklyn U.S. Attorney’s office.

 

Noel was detained and will testify against Sampson.

 

The report said that defence lawyer Nick Akerman

vigorously pushed back at the government,

conceding that Sampson committed some “ethical lapses”

If the Prosecutor's main witness is someone who's been convicted then the defense will do its best to impugn such testimony.
