White House drafts emergency order Trump could issue over wall funds: CNN

WASHINGTON (Reuters) - The White House is preparing an emergency declaration that President Donald Trump could issue as a way to circumvent Congress if lawmakers do not provide funding for a wall along the U.S. southern border, CNN reported on Thursday, citing internal documents.

The draft proclamation was updated as early as last week, a U.S. government official told CNN. CNN said Trump’s advisers remain divided on the issue.

The report comes as a bipartisan group of lawmakers introduced an amendment in the Senate that would temporarily open the U.S. government, which has been partially shut for a record 34 days over Trump’s demand for wall funding.

One senator said, however, he did not think the measure contained any wall funding.

Trump has insisted on $5.7 billion for a wall, an idea that was central to his electoral bid and a core part of his hardline policies on illegal immigration. Democrats have rejected his request, and have instead sought to provide funds for other border security measures.

The official told CNN that among options being considered to pay for a wall were pulling $681 million from a Treasury Department asset forfeiture fund, $3.6 billion from military construction funding, $3 billion in Pentagon civil works funds and $200 million in Department of Homeland Security funds.

“We’re looking at all our options” but nothing is imminent, a senior Trump administration official said when asked about the report. The Pentagon did not immediately respond to a separate request from Reuters for comment.

If an emergency is declared, the U.S. Army Corps of Engineers would construct the wall, CNN reported.

The documents say that environmental reviews could be skipped and that DHS could use waivers to bypass contracting laws, which could help speed construction.

He could technically get away with this approach but he would have to use the military to build the wall. In addition there would be lawsuits to block this move, however it will eventually end up in the supreme court which is already stacked in Trump's favor.

This might end up at the Supreme Court. He will use emergency powers if they do not reach a deal and win at the Supreme Court. 

I think that the Dems should try to strike a deal and as such both sides can claim victory.

Trump isn't building any wall. He is only saying that because he knows his base get excited when he does. If the Dems give him the money tomorrow, he will set it aside as once the wall is being built he will have nothing else to offer his base. He isn't going to get reelected next year. People are about to find out what was in that tax bill for them and they will have ulcers dealing with it this year and next so he is in lots of trouble by the time April comes around.

While Trump may make use of an Executive Order, it will be struct down by the various levels of Courts; even if it reaches the Supreme Court which has a majority of members purported to be associated with the Republican Party.

Among the issues for this specific Executive Order, it must demonstrate beyond a shadow of a doubt that the focused need for the border wall proposed by Trump is absolutely needed by the US_of_A.

Various sections of the U.S Constitution speak explicitly to this issue.
