IN an effort to confirm or negate allegations that Guyanese who were out of the jurisdiction during the conduct of the March 2,2020 General and Regional Elections are marked as voted, the Guyana Elections Commission (GECOM) has requested immigration records from the Department of Citizenship and Immigration Support Services, a move that could see the People’s Progressive Party/Civic (PPP/C) turning to the courts to stop the investigation from going ahead.

The A Partnership for National Unity + Alliance For Change (APNU+AFC) is contending that 1,261 persons voted in the place of migrants, and according to Elections Commissioner Vincent Alexander, a list of names has been provided to GECOM, and immigration records are now being sought, in accordance with the National Registration Act.

“Those [names] have been sent to the Chief Immigration Officer for verification,” Alexander told reporters at the Arthur Chung Conference Centre, where the National Recount of the votes cast at the General and Regional Elections is being done.

While the PPP/C has been objecting to the decision of the Elections Commission to accept evidence or information from the APNU+AFC, and or source death and immigration records, based on allegations made to date, Alexander made it clear that the request for immigration records by GECOM is provided for in the law.

“Like I said on a previous occasion, the Chief Immigration Officer, under Regulation 40 of the National Registration Act, has an obligation to periodically provide that information to the Chief Registration Officer, who is also the Chief Elections Officer. So I think within that context, the Chief Registration Officer has requested information from the Chief Immigration Officer,” Commissioner Alexander explained.

But PPP/C Executive, Anil Nandlall, in a separate interview told reporters that it would be illegal for GECOM to investigate the allegations being made by the APNU+AFC. “It is very clear that the Commission doesn’t have that mandate and that power, and it is not structured to receive evidence and those sorts of things; it is an elections Commission,” Nandlall told reporters.

He hinted at possible legal actions by the PPP/C if the GECOM moves to investigate the close to 2,000 claims of irregularities cited by the ruling Coalition. “Any time the Commission acts outside of its legal powers, the Court will be there to correct it,” Nandlall told reporters.

He added: “The PPP has nothing to hide, but the PPP will not participate in an illegal exercise. If GECOM goes down a road that GECOM has no power to travel, and wants to perform functions that GECOM has no lawful right and power to perform, then the PPP will not participate in that process.”

According to the APNU+AFC, some 1,937 numerical irregularities have been unearthed, thereby affecting 90,707 votes. The cases of alleged irregularities and electoral fraud are being included in the Observation Reports that are being provided to the Elections Commission. While this process is in keeping with the Order gazetted by the Chairman of GECOM, Justice (Ret’d) Claudette Singh on May 4, Nandlall believes that the Observation Reports are irrelevant to the process. Notwithstanding its inclusion in the Order, Nandlall believes that it is of little value to the Elections Commission.

“What you think the Observation Report is? It is a summary of the objections; the position is that GECOM cannot do anything with it. GECOM cannot do anything with it in law,” Nandlall submitted, while contending that the claims in the Observation Report cannot be investigated by the Elections Commission. GECOM, he said, should, upon the completion of the recount, proceed to declare the results of the General and Regional Elections, based on the report compiled by Chief Elections Officer Keith Lowenfield.

Nandlall submitted that the Court, under Article 163 of the Constitution, has exclusive jurisdiction to treat with cases of alleged electoral fraud. However, Commissioner Alexander sought to remind that the National Recount is being done under Article 162 of the Constitution, and Section 22 of the Elections Law (Amendment) Act, and not the Representation of the People Act.

“The Representation of the People Act did not allow for this recount that we are doing; it is the said Constitution, by virtue of Article 162, so that the determination of these matters in a common-law system is only final if a Court decides,” Commissioner Alexander said. “The view that we held by virtue of what’s in that Order, an Order which was agreed to by the Commission is that we are not doing a mere numerical recount; that we in fact going to have observation beyond the numbers, and we are having observations beyond the numbers,” he explained.

Former Minister of Business Dominic Gaskin has made a call for a full investigation to ascertain whether there was any wrong-doing on the part of individuals within the Guyana Elections Commission (GECOM) as it relates to the integrity of statements of poll or the tabulation of results.

According to the former minister, there are several issues arising out of the events unfolded over the past two weeks. He sought to address them via a Facebook post last evening. First and foremost, he directed his attention to the loss of confidence in GECOM, a critical national institution.

Speaking to this issue, Gaskin said, “Regardless of who is wrong or right or good or bad, GECOM cannot purport to hold credible elections in the future unless it can satisfactorily address the major concerns that have been raised about its declared results and the post-election processes leading to those declarations.”

Another concern raised by him was the inability of APNU and/or the AFC to win another election in the near future whether through public perception or bias.

He added, “This is a very likely consequence of what has taken place and doesn’t bode well for our future. I personally find the prospect of the PPP/C winning elections and remaining in power for another decades-long stretch quite frightening.”

The former government minister also said that the post elections happenings has caused societal damage from exacerbated ethnic tensions. He reasoned from all that has been said, implied and displayed since March 2, has severely damaged the fragile but admirable co-existence of our two major ethnic groups.

“In my view, race voting is not necessarily racism. Neither is the passionate advocacy for better conditions for a particular ethnicity. However, a lot of our recent behaviour has crossed the line and is clearly racist and harmful to social cohesion.”

It has been 19 days after polls were closed and still GECOM has not made a final declaration. As a matter of fact, GECOM is presently embroiled in several battles before the High Court over a controversial declaration made by Region Four’s Returning Officer Clairmont Mingo.

But it is not only that. APNU+AFC Candidate Ulita Moore has secured an ex parte interim injunction blocking GECOM, incumbent President David Granger and Leader of the Opposition from entering into an agreement for a independent high level team from the Caribbean Community (CARICOM) for supervising an overall recount of ballots cast in the 10 regions.

The Opposition has filed proceedings with the hope of having the injunction discharged.

The problem erupted after Mingo made a declaration for Region 4 which has close to 285,000 voters. The declaration made on March 5 placed the APNU+AFC coalition ahead of the PPP/C opposition by some 59,000 votes in District 4 and by approximately 7,000 votes overall in the General Election.

There was immediate and widespread rejection of this declaration, based primarily on procedural grounds and a lack of transparency, Gaskin reminded.

Gaskin admitted that he has taken a personal position on Mingo’s declaration. In fact, he does not buy his numbers.

“Who vex, vex! I am not attempting to convince anyone that my position is the right one. I’ve gone beyond that. I am also not condemning anyone for whatever position they may wish to take. Life is too short,” Gaskin made clear.

Among other things, he said, “We need a new model of governance which works for us and which doesn’t incite this level of divisiveness every five years. This is not something that can be left to any incumbent to address. It will never happen.”

He continued, “There must be a binding commitment from all parties as part of a packaged resolution of the current situation. Finding a permanent solution is not rocket science. Those who are not up to the task should step out of the way and allow better minds to figure it out – lots of bright young people in Guyana.”

“The real big men and women have to start talking to each other, or stop pretending to be leaders. Various other stakeholders need to set side aside their emotions and adopt a more conciliatory posture which puts the nation first.”

Unless we can bring ourselves to understand that there are good people on both sides of the 2020 elections controversy who genuinely believe the narrative coming out of their camps, Gaskin pointed out that we risk detonating the fuse that has been burning slowly for over six decades.

He added that all voters deserve to know the true result of the process in which they innocently and dutifully participated. In the eyes of Gaskin, General and Regional Elections 2020 has been nothing short of a national embarrassment.

“Elections 2020 has been a national embarrassment. If we cannot manage a simple election, how the heck do we plan to manage an oil economy? We seem to be doing everything possible to make up for the absence of natural disasters in this dear land of ours,” the former Business Minister concluded.

How can we trust anybody to create a voters list?  GECOM should tell the Politicians to butt out.   There should be no interference about any aspect of the election.  If there is an indescrepancy then it should wait until the count is completed before making any demands to the high counrts.  

It is the Politicians who are the real cause of this mess.

You title says GECOM opens probe, all opposition parties said that’s they are not aware if any probe.  Commissioner Gunraj, Irfan Ali and all smaller parties confirmed that no such task was taken up by the commission.  It all over the news including videos.

Vincent Alexander is quoted by the Guyana Chronicle today as saying that GECOM has opened up a probe into ‘allegations of fraud’ leveled by officials of the APNU+AFC during the ongoing recount.

It is worthy to note that none of the three opposition nominated Commissioners are aware of such a decision taken at the level of the Commission nor was there any such public announcement by the Commission itself. It appears that Alexander, a central figure in the APNU+AFC plot to rig the elections, has abrogated unto himself the role of GECOM spokesperson. He seems to be working with Roxanne Myers and others of the Secretariat to undermine the Commission and to give credence to APNU+AFC’s false allegations.

The CEO, Mr Lowenfield needs to urgently say whether he or the Chair has given directions to embark on an exercise outside of their remit.

Alexander is notably silent on the fraud perpetrated by Clairmont Mingo and apparently has no desire to have this investigated as it should be.

The APNU+AFC is once again in desperation mode as the amended recount order has given a finite date for the declaration; a move they had fiercely resisted. The declaration says:

‘The Commission shall, …………..no later than three(3) days after receiving the report, make the declaration of the results of the final credible count of the elections held on the 2nd day of March 2020’

A final credible count can only mean the recount since Mingo’s count was fraudulent.

Opposition nominated Commissioner of the Guyana Elections Commission (GECOM) Sase Gunraj on Friday questioned the source of a letter written to the Chief Immigration Officer following allegations that citizens who were not in Guyana for the March 02, 2020 elections were marked off as having voted.

Gunraj and his colleague Commissioners from the opposition People’s Progressive Party claim that any such letter did not emanate from the Commission and if it did then they were not informed.

Gunraj comments came moments after APNU+AFC nominated Commissioner Vincent Alexander said that the electoral body had dispatched a letter to the Chief Immigration Officer earlier in the week.

Calls are now being made for clarity on who sent the letter, upon whose authority and approval, with what intent and why are coalition nominated Commissioners aware while the Opposition nominated Commissioners are left in the dark.

Telephone calls to the Public Relations Officer Yolanda Ward for clarity on this issue proved futile Friday.

In the context of the veracity of this disclosure by Alexander, there are fresh calls for the relevant authorities to aggressively investigate the inflation of figures by Returning Officer of Region Four, Clairmont Mingo in favour of the APNU+AFC coalition.

The letter sent by GECOM reportedly contains a list of names of persons who are alleged to have voted while not being in Guyana.

Alexander said the move is for GECOM to ascertain whether there is any truth to the claims that “migrant electors” voted in a manner that amounts to electoral fraud.

But Gunraj said he is unaware of any such missive. He also says that the electoral body has no legal powers to investigate the allegations migrated voters.

“The law does not allow GECOM to conduct any investigation and further as far I know the Commission has taken no decision to investigate, Gunraj added.

Gunraj now questions whether the Secretariat of GECOM would have dispatched the letter.

“Indeed, if the Secretariat is engaged in such an activity they are engaging in a frolic of their own and will have consequences… assuming but not conceding it must be met with consequences,” he added.

Meanwhile, the PPP in a subsequent statement on its Facebook page said Alexander is notably silent on the fraud perpetrated by Clairmont Mingo and apparently has no desire to have this investigated as it should be.

Abu, Django or someone allegedly post in his handle sometime last year saying The Guyana Chronicle is not a reliable source and he don’t even look at this news media. It’s in the archives rite hay. Stabroek News was his go to.
