KNOWN critics of the government have been called out for seeking to create controversy, where none such exists, in the recent transfer of property by the Government to BK Marine Inc., owned by Brian Tiwari.

An Order gazetted on March 28, 2020, made its rounds on Facebook, and, later, in the media where the government was accused of selling prime waterfront property to BK, on February 26, just days before the March 2, General and Regional Elections. The Order was signed by Finance Minister Winston Jordan and saw the title of the immovable property of National Industrial and Commercial Investments Limited (NICIL) which amounts to 2.553 acres of land being transferred to BK Marine Inc.

The land includes: Mudlots 1 and 2, Cummingsburg, Georgetown; Lot ‘F’, a portion of Mudlot 3; and Lots ‘A’, ‘B’ and ‘D’ portions of North Cummingsburg, Georgetown.
The likes of Attorney-at-Law, Christopher Ram, called for an investigation to be launched into same and the Order was shared by a People’s Progressive Party/Civic (PPP/C) Facebook page alleging illegality on the government’s part.

In a release on Thursday, NICIL denied involvement in any shady deal and labelled reports suggesting otherwise as “absurd and crass”. The release stated that the properties were vested to NICIL via Order No. 43 of 2003 and 42 of 2003. On December 4, 2006, a lease was entered between NICIL and BK International Company Inc. for 20 years, with an option to purchase the property for $110,000,000.

The option to purchase was dependent on the Lessee obtaining approval from the Mayor and City Council for its intended construction works. NICIL said that this agreement was signed by former Head of NICIL, Winston Brassington and BK Inc. and witnessed by Marcia Nadir Sharma.

On November 19, 2009, BK Inc. exercised its option to purchase and ceased paying rent but NICIL rejected the offer to purchase. Years later, in June 2013, a legal action was instituted against BK International Company Inc. for rental arrears and accrued interest. The matter engaged the attention of the Court from 2013 to 2017 and sometime during 2017, BK Inc submitted an amended offer.

In August 2017, the matter was set down by the court pending settlement, and, in October 2017, NICIL made a counter offer to BK Inc. that included the original purchase price, all outstanding rent, and 50 per cent of the accrued interest. BK Inc. accepted the counter offer.

Then, in November 2017, NICIL submitted to Cabinet, a request for approval for transfer by sale. However, NICIL was informed that an objection was raised by the Ministry of Public Infrastructure on behalf of Transport and Harbours Department and, as a result, Cabinet’s approval was deferred.

In October 2019, NICIL received approval, following which the Vesting Order was prepared, signed and gazetted. Speaking briefly on the matter on Thursday, Minister Jordan confirmed that said matter was before Cabinet over two years ago and Tiwari is under the agreement of a lease which gives him the right to exercise a purchase should he so desire.

“He has the lease and the lease gives him the option to purchase and he tried to exercise his options and we had been investigating that,” Jordan said. The minister believes that no matter the time that the transfer was made, whether before or after the elections, the Opposition would have made it its duty to raise contention. However, he made it clear that Tiwari did not receive any favours from the government as the said agreement began under the PPP/C and represents a fair transaction.

Contacted on the matter, Tiwari, on Thursday, told the Guyana Chronicle that BK has been pursuing the transfer for over 12 years. “This thing wasn’t done with this government. This thing was done since in the days of the PPP. It was a tender and the tender clearly says what you had to do and we complied with whatever we had to do and we were waiting all the time for the transfer; that’s all,” he said.

He said the agreement involved was a Rental-Purchase Agreement for which three persons submitted tenders — inclusive of late realtor, Tony Reid. However, Reid died and the other person could not come up with the money so he won the tender and entered into the agreement on December 4, 2006. The agreement was signed between Tiwari and former Executive Director of NICIL, Winston Brassington. It detailed the requirements needed to be met before one became eligible to purchase the property.

Tiwari said these requirements were fulfilled but the agreement also mandated that a letter from a bank proving that one had the finances to purchase the property and that was provided. However, Tiwari was denied the purchase and possession of the property, took the matter to court and was ordered to pay the sum of $22M to be eligible for the purchase. Even though these payments were made, Tiwari said he was still denied ownership of the property. In 2017, a further agreement was signed with NICIL for the purchase of the property.

He said, even so, he had to wait years to see the realization of the transfer. Asked what he believed was the reason behind that, he stated: “That’s how the PPP operates. If they want to keep you behind the bars, they put you behind the bars; that’s how the PPP do it. You either be with them or you’re not for them.”

Recounting the years, he said that himself, Former Private Sector Commission (PSC) President, Edward Boyer, and businessman and close friend of Jagdeo, Bobby Ramroop had applied to the government for land but he was the only one who faced challenges. “The PPP hold this thing back from me,” he said. “The two got their transport and they shocked me out. I didn’t get but the two get; Bobby Ramroop and Eddie Boyer.”

Adding this position to the matter was former Trade Union Representative to the then Privatisation Board (PB), Lincoln Lewis.

In a public statement Lewis said he was in representation at the time of the bids for the property and what the government has done is merely complete a transaction intentionally stalled by the PPP government.

He said that Brassington had recommended at the meeting that a company registered at Phagoo Store in Regent Street, which had no track record with any business, be given the property in question. Lewis objected on the grounds that BK’s proposal was superior and satisfied the requirements demanded by PPP/C government. The entire PPP/C-appointed Board eventually agreed with the Trade Unionist who hadn’t known Tiwari at the time.

“What is instructive about the PPP is that that government took time in making sure the final and legal transfer of these properties were never brought to finality. The reason behind this behaviour, is that if for any reason whenever one wants to approach the bank or third party to be involved in any business it will require permission from the government to do so. As such, if the person to whom the property is given should take a position that conflicts with the government, the owner will never be able to get the support or comfort to do any business with a bank or third party,” Lincoln said.

He added: “What the coalition government has done is complete what the PPP government started- but for whatever reason failed to do- in moving to give legal transfer to the owner.”

Less than a week before the March 2nd elections, Minister of Finance Winston Jordan granted permission for a number of state assets to be sold, among them some 2.5 acres of prime land at Mud Lot, Cummingsburg, Georgetown, to BK International.

And while the results of the polls remain marred in controversy that has seen this country in a political stalemate since then, in the Official Gazette publication of Tuesday, March 28th 2020, notification of the sales were made.

“The title to the property shall, as from the Appointed Day, stand transferred to and shall be vested in the purchaser absolutely, free and clear from all claims and liabilities,” the Order, cited as the National Industrial and Commercial Investments Limited (Transfer of Property) Order, in the Gazette’s Legal Supplement, states .

For the sale and transfer of state property from NICIL to a buyer to be legal, the Minister of Finance would have to make the order.

This newspaper yesterday tried contacting Jordan to ask about the grounds for the sale at such a time, when the Caribbean Court of Justice had ruled that the government is in caretaker mode.

The ministry’s Public Relations Officer Wanita Huburn was reached and she said that she would have to see the documents before replying. This was done but up to press time there was no response from her or the minister.

The three parcels of land sold total 2.553 acres.

The publication of the order drew much criticism with former Attorney General and PPP/C executive Anil Nandlall calling it an illegal act.

“In the ordinary course of things, a caretaker government does not dispose of state assets, does not acquire or dispose of state property. It is only to manage the country and provide essential services. Selling prime property at this time, when the government has lost the election, makes it even worse. One week before the election a caretaker government would do this?” he asked.

“While a government remains in power, the framers never contemplated that that government would not commit acts like these, and essential services alone,” he stressed.

Nandlall said that the elections came and the APNU+AFC government was “still holding on to power” and went ahead and published that the order was signed.

“The other thing is them remaining in power for such a protracted period. And it is not remaining in power because of some natural disaster or some unforeseen and unpreventable act, it is staying in power because of circumstances it created through its own political machinations,” he said.  Nandlall contended that it shows abuse of power. “This government has lost the elections and they know they have lost. This is not only illegal, it is a vulgar abuse of power. To crown it off, this is a political party that campaigned on the platform of honesty and integrity. Almost everything they have done since March 2nd has been dishonesty and without integrity,” he argued.

The sale will also raise serious questions as BK International has maintained close links with the government and has been seen as one of its key supporters.

A decision to sell a Water Street wharf to businessman, Brian ‘BK’ Tiwari, days before the March 2nd elections is emerging as a bitter fight now.

The People’s Progressive Party/Civic (PPP/C) made it clear yesterday that it remains deeply suspicious of the transaction and whether Guyana received value for its money.
The wharf has been in the possession of BK International Inc. for over a decade. It is an area that belonged to the entity once known as the Guyana Rice Board (GRB).
However, after a suspicious fire, it was leased to BK by the state’s National Industrial and Commercial Investments Limited (NICIL)/Privatisation Unit.
Yesterday, former Junior Finance Minister, Juan Edghill, stated that Guyana will have to start way back when the Coalition Government was defeated on December 21st, 2018 by a no-confidence motion.
“As a caretaker government – this was underscored by the Caribbean Court of Justice – it had limited powers. It basically gifted this parcel to land to a known financial supporter, while it obviously could not do so. In fact, it was preparing for elections.”
According to Edghill, the property now would be worth tens of millions of dollars because of the evolving oil and gas industry.

In fact, between Stabroek Market and Kingston, it may very well be the only available riverfront property.
“…and for the ordinary man, that is a golden handshake to BK Marine. The second disturbing thing, even if is a legitimate transaction, why was there no public notice, and no public invitation or competition bidding? How are we to be assured that there was value for money in the transaction and that Guyana got a good deal?”
According to the former parliamentarian, it would be instructive to note that it was the Coalition Government which established a State Assets Recovery Agency, “with a claim that previous administrations gave away from lands below market value. They stand to be judged by that same principle.”
According to Edghill, the transaction is vulgar and reeks of mindset that has no decency and characterizes the Coalition.
“It certainly is a matter to be investigated when PPP/C takes office…along with countless other transactions we are discovering.”
Meanwhile, the transaction was defended by Lincoln Lewis, a trade union representative that once sat on the Privatisation Unit board of directors when it was being considered to be leased.
According to Lewis, the property in question was put up by the Bharrat Jagdeo government, prior to 2011 for sale.
“That property which is located in Water Street was the former Guyana Rice Board wharf which was burnt down through questionable circumstance during the life of the PPP government. Among the bids for that property was one from BK International.
Lewis explained yesterday that Winston Brassington, the former Executive Director of NICIL/PU, recommended at the meeting another company the property must be given to.

“That company proposed by Brassington was registered at Phagoo Store in Regent Street and had no track record with any business. I objected, because I looked at the proposal of that company, BK International and others, and found BK’s proposal to be superior, satisfying the many requirements demanded by PPP/C government.”
Lewis said that at the time, he was supported by other members of the board to favourably look at the BK proposal.
“The entire board, appointed by the PPP/C government, agreed we will recommend to Cabinet the property will go to BK. Let me make it very clear, I never knew Brian Tiwari (main principal of BK Marine) at the time, but met him subsequently at the funeral of Mr. Lewis, the original owner of Water Chris Hotel.”

Lewis said that what the Coalition Government has done is complete what the PPP/C government started – but for whatever reason failed to do – in moving to give legal transfer to the owner.
“I sat on the Privatisation Board when BIDCO House was transferred to Gerry, Captain Gerry Gouveia, currently Chairman of the Private Sector Commission. This property, which is situated in Duke Street, Kingston, he has converted into a business called Duke Lodge. The same principle that applied for BK getting his property applied for Gerry.”
According to the Official Gazette of March 28th, 2020, the order was signed since February 26th, 2020 by Minister of Finance, Winston Jordan.
Elections were a few days later, on March 2nd.
The Transfer of Property Order to B.K. Marine Inc. of Queenstown would give the purchaser absolute title to the property. The property had been held by the state’s National Industrial and Commercial Investments Limited. The notice in the Official Gazette did not give a price.
The transfer of Mud Flat lands included three properties, including erections and totaling 2.553 acres.
The transaction was earlier this week described as highly suspicious, with calls for a probe.
“This obviously smells…a couple days before elections. It is completely unacceptable,” said attorney-at-law, Christopher Ram.
Ram, also a Chartered Accountant, made it clear that the transaction would be seen by some as immoral, and not how a caretaker government should be handling the assets of the state.
“Any transactions since the CCJ ruling of last year ought to be reviewed…from a good governance stance, and of course, in the interest of protecting the assets of the state.”
Attorney-at-law Sanjeev Datadin was clear, that the transaction will not withstand scrutiny.
“This is a transaction that was done by a caretaker government. How could you enter an agreement days before elections when you are just holding on for the sake of elections? Obviously, it is a transaction that will have to be reviewed.”

Winston Jordan signs away State lands to APNU/AFC financier 6 days before elections

The transaction has since been detailed in the March 29, 2020 publication of the Official Gazette, documenting the sale of Government land to one of the coalition Government’s key financial supporters.
The order, signed by Minister Jordan on February 26, just six days before the General and Regional Elections, documents the Transfer of Property Order.
The land in question includes Lots One and Two Mudlot, Water Street Kingston, in addition to Lot F, being portion of Lot 3, in addition to three others in North Cummingsburg, lots encompassing just over two and a half acres.
According to the Gazette, a copy of the certified order is to be deemed as conclusive evidence that BK Marine Inc has absolute title to the property.
Weeks after the coalition A Partnership for National Unity/Alliance for Change (APNU+AFC) took Office in 2015, Tiwarie emerged as one of the key financial backers of the parties, and had joined in a massive cleanup effort in and around the city.
He was also involved in the construction of the controversial D’Urban Park Project, and was also handed a US$5 million payment from Government after threatening to sue over disagreements with a state contract.
Another APNU/AFC financier, Lloyd Singh, was handed a massive 164,000 acres of prime State Forest located along the Berbice River just three days before this year’s election.
Incidentally, it is one of the same areas that the current APNU/AFC Administration repossessed recently.
Guyana Times was told that the last-minute allocation of Guyana’s State Forest was done via a rushed and uncompetitive process that was engineered to favour this particular individual.
A source at the Guyana Forestry Commission told this newspaper that it is highly unusual that an area of this stocking and location had only a sole applicant.
Singh is a known financier of the Government; and in fact had funded the AFC’s head office located on the Kitty Railway and Embankment in Georgetown. At the time, party Leader Raphael Trotman had said in reference to Singh’s apparent generosity, “Businessmen make investments in political parties, and expect a return on their investments.”
