Burnham 1980 Constitution does have folks going around in circles.

Chairperson of the Guyana Elections Commission (GECOM), Justice ( Ret'd) Claudette Singh is utilizing Section 18 of the Election Laws Act No 15 of 2000, to DICTATE to the Chief Election Officer on what ADVICE he should provide to the Commission.


Article 177 (2)(b)....Presidential candidate shall be DEEMED to be elected as President and shall be so declared by the Chairman of the Elections Commission ACTING ONLY IN ACCORDANCE WITH THE ADVICE OF THE CHIEF ELECTION OFFICER, after such advice has been tendered to the Elections Commission at a duly summoned meeting.

Based on Article Article 177 (2)(b) it is clear as day that Madame Chair CANNOT DICTATE to the Chief Election Officer as to what ADVICE must be provided to the Elections Commission, as such the action of Madame Chair based on the Gazetted Order is inconsistent with the Constitution of Guyana and therefore to the extent of the inconsistency is VOID.

NO other Officer of the Elections Commission can provide such ADVICE to the Elections Commission other than a substantive Chief Election Officer.

Article 177 (2)(b) is indeed clear that the advice from the Chief Election Officer to the Chairman of GECOM must comply with the specific laws and process of the matter in hand.

The matter specifically relates to the election result by the Statements of Recount --SORs-- copies of which were provided to each political group and the original ones are with GECOM.

While all political groups know the results because of the SORs, it is GECOM that officially declares the results.

Hence, the information to be presented by Keith Lowenfield to GECOM's must coincide with the SORs presented to each political group.

Don't be sure sure. The APNU is like a dangerous animal . When its back is against the wall it will come out attacking. Remember, Granger promised his supporters a good life. They expect that.  APNU is not going down without a fight. Theres a good chance some kind of violence can break out.  Problem here is, while coolie people burn tires and cornfields APNU supporters will burn down buildings. But let's hope it doesn't come down to this.

Breaking: Lowenfield fails to submit elections report, claims “clarity” needed

Chief Elections Officer Keith Lowenfield has failed to submit his final elections report as instructed by GECOM Chairperson Justice Claudette Singh.

Lowenfield was directed to submit the report, using the recount figures, by 14:00hrs today.

Guyana Times understands that the CEO is claiming that he needs “clarity”.

In her letter to Lowenfield, dated July 9, the GECOM Chair’s instructions were very clear.

She stated: “Section 18 of the Election Laws Act No 15 of 2000 stipulates that you are subject to the direction and control of the Commission.”

She further stated that: “In accordance with this section, and pursuant to article 177 (2) (b) of the Constitution and section 96 of the Representation of the People Act Cap 1:03, you are hereby requested to prepare and submit your report on the March 2, 2020 General and Regional Elections by 2pm on 10th July, 2020, using the valid votes counted in the National Recount as per Certificates of Recount generated therefrom.”

The seven-member Commission is currently meeting.

Preparation of reports by Keith Lowenfield must be done pursuant to the directions of GECOM.

I understand that lowenfield got  a math problem. But i didnt realize that he had a comprehension problem as well. How much more clarity he needs.

Must have failed both maths and english at the same time 😆 makes me further think how the hell he became a CEO. 😆

They would rather him in office to do their bidding, than a God-fearing, honest man.

Keith Lowenfield retired from the army where he served as a junior officer to David Granger.

Lowenfield was appointed by Steve Surujbally in 2014.

Interesting that Surujbally stated that there will be non-controversial issues by Lowenfield plus he hoped that he-Lowenfield will conduct his duties in a proper manner.     

Perhaps, we are seeing what Surujbally means by proper manner.

Who sold Guyana's oil reserves for a mere 5% of the profits?

Who sold the mineral deposits in the Rupuruni district in 1987 for a mere 5% of the Profits?

First off, Jagdeo is not my dearest. And what proof do u have that he sold Guyana to whoever you're claiming.  Were u there when these transactions took place? And what bidding are u talking about. Do explain. And if it's Granger u are referring to as this god fearing man, please..this is not the time to be cracking tasteless jokes.  And as far  sanctions goes, rest assured u are in no way like some of us here affected by that since u appear to live overseas. 

Btw, on the topic of greed. Where did the money from the treasury go?  I've seen nothing of value that the APNU did for the Guyanese people.  Not one new road or a mango tree planted. Somebody pulled a Mandrake?
