BREAKING: Full Court throws out injunctions blocking recount

The Full Court, comprising Chief Justice Roxane George and Justice Nareshwar  Harnanan, on Tuesday discharged the injunctions granted by the High Court Judge Franklyn Holder on March 17 in which he stopped the Guyana Elections Commission (GECOM) from carrying out a national recount of votes cast at the March 02 general and regional elections.

In a unanimous decision, the Full Court ruled that Justice Holder made an error in determining that he can hear the case filed by APNU+APNU Candidate Ulita Moore.

Justice Holder ruled on March 27 that he can hear the case and that it would be tried, but Justices George and Harnanan found that it is not within the court’s jurisdiction to review decisions of GECOM to carry out its mandate.

According to Justices George and Harnanan, the filing of the proceedings by Moore prevented GECOM from effectively carrying out its functions to facilitate elections.

In handing down the decision, Justice George said that the entire scheme of the country’s elections law allows GECOM to resolve difficulties that arise.

Justice Holder granted the orders at the request of Moore, who was an East Coast Demerara candidate for the Coalition in the 2018 Local Government elections and a Region Four candidate for the Coalition in the March 02 elections.

He granted an order restraining GECOM from permitting or authorising any actions pursuant to the agreement initiated by the President and agreed to by the Opposition Leader for a CARICOM High-Level team to supervise the recount.

The agreement was signed Monday night. The Full Court has now vacated that order.

President David Granger and the Opposition Leader Bharrat Jagdeo had agreed to a national recount of all votes cast in the ten electoral districts.

Moore also applied for and was granted an interim order blocking the Elections Commission from setting aside the declarations made by the ten electoral districts.

An order was also made blocking the Chief Elections Officer from preparing and submitting a report to GECOM on the declarations that have been made. That order was also vacated.

Article 162 of the Constitution, the Full Court noted, gives overriding powers to GECOM to manage the elections. The Court ruled that the Constitution and Parliament gave GECOM the authority to operate independently to resolve difficulties as these may arise.

The full GECOM met and agreed that a CARICOM supervisory team would be the mechanism to address questions that arose about the tabulation of Statements of Poll to arrive at an acceptable elections result.

By now Granger should have come out from hiding and say publicly and clearly that he does NOT support rigging and make every possible facility available to see votes are counted transparently and credibly ... every wondered why he doesn't? His own election in Congress Place was rigged for him to become leader instead of the true winner Carl Greenidge. Granger became President after the 2015 election was rigged. Granger is the ultimate proponent and beneficiary of rigging and wants to continue to be.

Lowenfield should make a statement that it has come to his attention that one of his subordinate, Mingo bastardized the SOPs of region 4 and he is now taking control of correcting that situation by utilizing his SOPs to properly and transparently count the votes. The gig is up for these fools and more stalling only makes them look more stupid. Meanwhile Totaram still braying that GECOM already has the results published.

DEMOCRACY WILL PREVAIL OVER TYRANNY

From its inception, electoral democracy has always been based upon the will of the majority. So it has been for centuries and so it will be for eons. Societies in which this system obtains, have always accepted this reality. Today, they constitute what is now regarded as the free world. Democracy is the name of the game. The will of the majority is its most quintessential rule. Those who subscribe to the game are bound by and always bind themselves to that rule.

In some countries, the political systems have been altered to suit the needs and peculiarities of those societies. As a result, there are occasions when a majority vote does not yield Government. For example, five Presidents of the United States of America were elected and allowed to govern, though not winning the popular vote. However, those are the rules by which they agreed to play. When the results come, they do not and cannot quarrel with those rules. In such an instance, it means more people did not vote for the Government than those who voted for the government. Yet, you not once hear about β€œhalf the country being left behind”.

Political parties from all over the world have drawn their core support from particular constituencies that constitute formidable segments of the demography in those societies, be it class, religion, sects, tribe, caste, ethnicity, race, ideology, etc. So, every time one political party wins an election, its constituency wins and the other constituencies that do not win must accept defeat. These are the rules of the game. However, not for one moment, does this mean that a government so elected, must focus only on its own constituency. It must govern for all. Sagacious politicians, who lose, would normally begin to work to win the next elections. These are also the rules of the game.

What is absolutely prohibited is when one party loses, that party fraudulently uses the state apparatus and public funds to project false results, in order not to give up government and worse yet, refuses to give up government, when those fraudulent results attempts are subverted by clamouring to β€œshare the government” with the winner, on the basis that their constituency would be left behind. If this is ever allowed to prevail, then it will be the end of modern electoral democracy as we know it. If President Donald Trump loses the next election, he will refuse to give up power and will demand that the Democrats share government with him because if not, the Republicans, constituting half of the population of the United States, would be β€œleft behind”. Just imagine for one moment this horrendous occurrence replicating itself across the globe. It will sound the death knell of democracy and the birth and glory of tyranny.

This is the tragic narrative of those who have lost the 2nd March 2020 elections in Guyana. The free world will never countenance it. The PPP lost the 2015 elections by just over 4,000 votes. The APNU+AFC lost the 2020 elections by over 15,000 votes, by nearly four times more votes than the PPP lost by in 2015. The PPP, in the traditions of democracy, gave up government. The PPP, from its birth, have always commanded the electoral support of over 50% of the population. That reality has not changed. To those who speak about Indian domination, I say that, currently, the Indians constitute a mere 39% of the population and the Africans extremely close behind. Therefore, it is not about Indians and Africans. It is about leadership, policies and programmes. Those are the foundation pillars Dr. Cheddi Jagan built and left in the PPP. Nothing stops the other political parties from emulating the Father of the Nation.

Their narratives will never succeed. The quicker they understand that, the better.

First, the Court's decision is needed.

If the decision is that the tabulation of votes must proceed according to the Constitution requirements, then GECOM must proceed as thus.

Having CARICOM and others involved could then be decided anew.

Jagdeo and Granger agreement has no bearing on this process; it is at best simply a suggestion.

Cook-up Rice Gal, Region 4 count was never completed in the presence of all the political representatives. Remember Drama Queen Mingo was getting shittings half way during the counting when he saw the scale was tilting for the PPP, he never return to complete the count. Either that he can't count big numbers.

 GECOM get your asses and complete the process, no more delays, ABCE are WATCHING, they are given till Saturday.

Incorrect.  An election petition can only be filed when the election is completed and results are declared. How can Granger be declared winner when he lost the election by 4 seats?

Roach Gyal Rochelle must be reminded that the High court ordered GECOM to COMPLETE the count. They stalled again after Ulita Moore field her illegal petition at the incorrect court. That was thrown out and now the count must be completed according to the High Court. Rochelle is taking sheer Pee Pee. 
ABCE also clearly stated they Region 4 must be completed and verified before anyone can be sworn. Don’t believe Rochelle and she Pee Pee statement.

Cancer man granger stuck in de mud and ran out of excuses. What a dog !

(2) Jadeo ,petitioned for GECOM to present SOPS ,Court ruled that have to be done  by an Election Petition.

(3) Jagdeo ,petioned to void Mingo second declaration of results of Region 4, Court ruled doesn't have Jurisdiction to hear matter.
