General election in Guyana is now constitutionally overdue’ – Commonwealth SG

The Commonwealth Secretary-General, this morning, called for the restoration of constitutional rule in Guyana and urged that General and Regional Elections be held without any further delay.

Secretary General, Patricia Scotland, said that she has taken note of the June 18, 2019 ruling of the Caribbean Court of Justice while noting that Guyana’s Constitution firmly sets out requirements for elections following the passage of a No-Confidence Motion.

The Commonwealth Secretary-General, Patricia Scotland, urges the President of Guyana and all relevant stakeholders and institutions to restore constitutional rule in Guyana by immediately setting an early election date in consonance with its constitution, enabling elections to be held without further delay.

The Secretary-General has taken note of the 18 June 2019 ruling of the Caribbean Court of Justice (CCJ) and its consequential orders of 12 July 2019.  The CCJ’s ruling was clear that the Guyana Constitution sets out certain requirements for the time of an election after the valid passing of a no confidence motion.

The rule of law and constitutional governance are fundamental Commonwealth values to which Guyana has subscribed.

In this regard, and in accordance with the ruling of the CCJ, a general election in Guyana is now constitutionally overdue. A general election should be held in accordance with the unambiguous constitutional imperative to do so.  The Secretary-General has spoken with the Chair of the Guyana Elections Commission (GECOM) and discussed Commonwealth support to GECOM.

Thursday’s pronouncement by GECOM Chair Justice (Rtd) Claudette Singh that GECOM will not be ready for general elections until the end of February 2020 contravenes the express requirement in the Guyana Constitution for elections to be held speedily in the aftermath of a motion of no-confidence. It defies belief that given her jurisprudential experience and her presiding over an election petition case where she made a ground-breaking ruling that Justice Singh would be so dismissive of the clear meaning of articles 106 (6) and (7) of the Guyana Constitution.

If meeting the requirements of those articles required the abandoning of the raw, untested data of the controversial house-to-house registration process then that was what Justice Singh needed to do. She has failed to discharge her obligation as a custodian of constitutional strictures. Justice Singh has pulled a date magically out of nowhere. She must urgently publish the schedule that led her to the end of February and explain to the public how those schedules will be kept and whether there could be any compression of the timeframes.

 

As her February decision will be seen as a capitulation to the demands of APNU+AFC, Justice Singh now faces a monumental hurdle in convincing all of the electorate that she will be fair and evenhanded in her decision making.

Now that he has been given an approximate date for general elections, the public  expects that President Granger will declare a date for the polls as he has promised to do on many occasions. This date should ideally fall at the end of February so that there will be sufficient time for the preparation of a budget for 2020 by the incoming administration.

What if Granger picks 20th May 2020 for the election it will be in keeping with what the Chair lady said ie. Sometime after the end of February 2020. Cancer Granger is the living dead he don't care rats ass with what anyone has to say. He is a Dictator.

I think Granger is caught between declaring an election date more so to appease the ABE, but he still wants to punish the opposition because of the recent protest....so he taking his time to make the inevitable decision.

If he wants to delay, which I am tempted to believe, he will blame the opposition for not giving him the 2/3 majority....more reasons for him to cook up a Plan B.

Everyone playing games.  And Granger pushing the envelope.  Granger cares little about protests. The economic power of the PPP have dissipated and he sees oil on the horizon.   The PPP and it’s supporters will not cause physical harm or property damage, so he will let them protest.  He would be more concerned with international action but that’s some time before it comes to fruition.  The war of attrition continues!

Meanwhile it is now more than nine months since the NCV and the Coalition is behaving like they don’t understand English. Only a matter of time before international disbursements cease. I also support a freeze of all balance of payments until the Coalition begins obeying the laws of Guyana.
