Nandlall says the Commonwealth Law books were sold to him

May 22, 2017 Letters, http://www.kaieteurnewsonline....ks-were-sold-to-him/

Dear Editor,
Please find attached a correspondence received from Lexis Nexis (UK) in respect of my relationship with that company in respect of the purchase by me and delivery by the company of Commonwealth Law Reports, dating back over a decade.

The correspondence is self-explanatory. It corroborates every material detail I disclosed about this transaction over a year ago.

However, I wish to highlight the company’s assertion that they never sold and delivered these books to the Government of Guyana, nor the Attorney General Chambers, nor the Ministry of Legal Affairs between the period 2012-2015, or even to date.

You will note that at all times these books were sold and delivered to me and that it was I, who directed their delivery to the Ministry, during my tenure as a Minister.

This correspondence should finally put to rest the issue of ownership of those books. It is not legally possible for a person to steal his own property.

The charge instituted against me, therefore, is not only bad in law but it is an expression of malice and incompetence by those who instituted it and by those who inspired its institution.

I said from the inception that the charge had nothing to do with law, but more to do with political witch-hunting and political vendetta. I am being vindicated with each passing day.

A professional worth his salt, would do the honourable thing and withdraw the charge. But I doubt this will happen in this instance.
Mohabir Anil Nandlall, MP

Attorney-at-Law,
Notary Public,
Commissioner of Oaths to Affidavits & Justice of Peace

Editor’s note: We did not carry the attachment Mr. Nandlall referred to because we are of the opinion that it infringes on the sub judice principle.

who money paid for the transaction,

As part of my benefits, my employer in Canada, the a federal government, paid the subscriptions of the professional journals to which I was subscribing. When I left, I took the magazines and journals, they belonged to me because it was one off the benefits of the package.

Your dislike for the PPP leads you to make statements that lead one to question your intellectual level.

Cain, what is the new story? This statement, as far as I know, confirms what Nandlall has said since this became a big issue.

I disagree with the way he handled the issue, but that is his personal preference. Maybe, he knew the legal grounds on which he stood and preferred to make a stand.

when the matter is settled in court, we will then know if he made the correct decision.

As is the custom and practice, especially for professionals.

Also, if the employer does not pay, the individual can make the deductions for the journals through their income tax returns.

Are there any clause in Nandalall contract  states the gov't will pay for the subscription ??

Was the part of your benefit for the subscription stated in the contract ??

How do you conclude my dislike for the PPP ?? since when speaking out of wrong doings become dislike.

I am siding with Anil Nandlall on this LexisNexis dispute. I think that notorious bungler Basil Williams' action is driven by personal animosity towards Nandlall.

Ex-President Donald Ramotar wrote a letter to the press confirming Nandlall's contention that the LexisNexis subscription formed part of his employment remuneration and benefits. I hope Basil's 5 advisers persuade him to back off.

Gilly I thought Donald said that he gave Nandalanda those books.

β€œin the case of the law books, the former President Ramotar wrote the Auditor General’s office, and stated that he and the then Attorney General had some sort of private agreement that the Attorney General would spend money from the votes of (money budgeted for) the Ministry of Legal Affairs to buy the law books and keep them for himself.”

"private agreement" means different things to different people. I interpret it to mean that President Ramotar assured Mr Nandlall either face-to-face at OP or on the phone that LexisNexis subscription was part of his employment package.

Was that illegal or unconstitutional? NO. Ramotar was performing a presidential function in hiring an Attorney General. Under the Constitution, the President cannot be charged by police and dragged to court for actions relating to his functions. Also, the President has discretionary powers.

Whoever insists in taking bungling Basil's side in this dispute is on the wrong side of history.

Classic bhai,

Burnham the despot screwed the Country and the people they have to abide with the fraudulent referendum that gave them the Constitution. The wrong doers have a good tent to cover up their wrong doing.

That country is doomed with the two Political Parties PNC and PPP,wan revolution needed to wipe out these miscreants.

This is why you should join the Gillyist movement and call a stink pozee a stink pozee. This coalition is no better than the previous regime.

The pro-PPP posters here are clearly reluctant to find fault with the Jagdeo-Ramotar regimes, but that fact does not invalidate their criticism of the present administration. Moreso, thousands of coalition supporters are disappointed and disjointed these days.

Personally, I think the pro-PPP supporters here are justified most times in their criticism, nevermind their uncultured choice of language.
