Berbice Cricket Board Elections set for Oct 8 following court ruling

Rabindranauth Saywack, an Ex-Executive of the Berbice Cricket Board of Control informed that the GCBC Elections is set for October 8 after a ruling by the Honorable Justice Navendra Singh who on Friday September 8, 2017 in chambers paved the road for this becoming a reality. The BCBC Elections was last held in January 2014.
In a court action brought by Saywack and Albert Smith, both former members of the Executive Committee of the Berbice Cricket Board of Control in action # 9/ 17 /FDA, challenging the actions of Mr. Dhieranidranauth Somwaroo, the purported President of the Berbice Cricket Board to dismiss members of the Board, appoint new members and to elevate himself to the Presidency amongst other things.
Saywack said this action was first heard by the Honorable Madam Justice George, then by the Honorable Justice Franklin Holder who ordered the parties to engage in mediation before an approved Mediator. In this process both parties agreed to the appointment of Mr Tejram Ramroop, Attorney at Law. This process subsequently failed and the matter was referred to the High Court.
He explained that it was then placed before the Honorable Justice Navendra Singh who on Friday 08- 09- 2017 in chambers ruled:
-The life of the Executive Committee that was elected in 2014 expired in December, 2015.
– That the election of Somwaroo as President of the Berbice Cricket Board is null and void and of no legal effect.
-That elections of the Berbice Cricket Board of Control be held on the 8th of October 2017.
-That the actions of Somwaroo as President of the Berbice Cricket Board is null and void and of no legal effect.
– That Mr. D. Somwaroo ensure that Notices be sent to all parties in accordance with Schedule 3 of the Guyana Cricket Administration Act for the purpose of electing office bearers to the Berbice Cricket Board Of Control.
This action was brought by Mr. A. Gossai- Attorney – at law – on behalf of Mr. Albert Smith and Mr. Rabindranauth Saywack, while Attorney Roysdale Forde appeared for Mr. D. Somwaroo, Godwyn Allicock, David Black, Annand, Sanasie and others.
The ruling of the High Court therefore vindicates Mr Saywack and Mr Smith that the actions of Mr. Samaroo and others was tantamount to a hostile takeover of the BCB by person/persons aligned to the Guyana Cricket Board an organization with which the BCB has a long running dispute.
This decision of the Honorable Justice Navendra Singh has now cleared the way for the long awaited elections of the Berbice Cricket Board of Control.
It is also pertinent to note that Mr. Samaroo and others would have violated the order of March 07-2017 issued by the Honorable Justice Madam Roxanne George, restraining Mr. Somwaroo and others from conducting a planned meeting on March 19, 2017 with the express purpose of electing Mr. Somwaroo and others into executive positions of the Berbice Cricket Board of Control.
Cricket pundits in Berbice are now looking with heightened interest as to how these issues would be resolved.
