PUBLISHER of Kaieteur News, Mr. Mohan Lall, commonly referred to as Glenn Lall, yesterday was served a summon to re-appear in court on Monday to answer charges that relate to defrauding the Guyana Revenue Authority (GRA) of duties, before Magistrate Judy Latchman.

 

In mid-October, Lall and his wife Bhena were arraigned at the Georgetown Magistrate’s Court.


The filing of the charges followed the disclosure of details of an alleged duty-free scam which were made public by the Guyana Chronicle after a close examination of the Government of Guyana’s review of the Remigrant Scheme.


The couple, who reside at Nandy Park, East Bank Demerara, denied the charges that were read to them by Chief Magistrate Priya Sewnarine-Beharry.


The defence was represented by high-profile lawyers, some of whom are also prominent politicians. The list of lawyers include: Mr. Khemraj Ramjattan, Senior Counsels Rex McKay, Nigel Hughes, Christopher Ram, Joseph Harmon, Brendan Glasford, Bettina Glassford and Robin Hunte.

 

CHARGES READ
In their first appearance in court four charges were read to Lall and his wife. They state that:
1. The two parties were knowingly concerned in the fraudulent evasion of import duties of Customs on vehicle, PRR 8398, contrary to Section 218(e) of the Customs Act, Chapter 82:01.
2. The two parties were knowingly concerned in the fraudulent evasion of import duties of Customs on vehicle, PRR 8399, contrary to Section 218(e) of the Customs Act, Chapter 82:01.
3. Glenn Lall and Bhena Lall, knowingly dealt with goods with intent to defraud the revenue of duties thereon to wit one (1) Lexus LX 570 Motor Vehicle registration number PRR 8398 with engine capacity 5700 cc, Chassis No. JTJHY7AX6 D4094851, contrary to Section 218(d) of the Customs Act Chapter 82:01
4. Glenn Lall and Bhena Lall, knowingly dealt with goods with intent to defraud the revenue of duties thereon to wit one (1) Lexus LX 570 motor vehicle registration number PRR 8399 with engine capacity 5700 cc, Chassis No. JTJHY7AX6 D4094851, contrary to Section 218(d) of the Customs Act Chapter 82:01.

 

Defence counsel, Ramjattan requested that his clients be released on their own recognisance, which is self-bail and this was granted.


Representing the prosecution was attorney-at-law Mr. Mahendra Satram and Sandil Kissoon.


Additionally, the other two parties involved in the alleged duty-free scam, Narootandeo and Gharbassi Brijnanan, did not appear to answer the charges against them.


The charges against the two remigrants state that:
1. The two parties were knowingly concerned in the fraudulent evasion of import duties of Customs on vehicle, PRR 8398, contrary to Section 218(e) of the Customs Act, Chapter 82:01.
2. The two parties were knowingly concerned in the fraudulent evasion of import duties of Customs on vehicle, PRR 8399, contrary to Section 218(e) of the Customs Act, Chapter 82:01.
3. Narootandeo and Gharbassi Brijnanan did make and subscribe to a false declaration in a matter relating to the Customs, contrary to Section 217(1)(a) of the Customs Act Chapter 82:01, involving a vehicle PRR 8398
4. Narootandeo and Gharbassi Brijnanan did make and subscribe to a false declaration in a matter relating to the Customs, contrary to Section 217(1)(a) of the Customs Act Chapter 82:01, involving a vehicle PRR 8399.

 

The lawyers representing Glenn and Bhena Lall are expected to be the same group of lawyers representing the Brijnanans.


Altogether, six criminal charges were filed against Lall and the Brijnanans.

 

DETAILS DISCLOSED
Under the remigrant programme, Guyanese who would have resided overseas for more than five years and are returning home to reside are entitled to a number of benefits, among which are import duty-free waivers for vehicles, and tax exemption for household items, once the items at reference were owned for six months or more in the country where the remigrant was living.


In Lall’s case, husband and wife Narootandeo and Gharbassi Brijnanan were entitled to concessions as two separate individuals, although a joint application was submitted.


The Brijnanans, having decided to return to Guyana to live permanently, were entitled to certain tax breaks, so they imported two luxury vehicles. But the address they gave on the registration forms for both vehicles, Lot 8 Continental Park, East Bank Demerara, was that of their son, Navin Sankar, even though the Lalls are the primary users of the vehicles.


The vehicle, PRR 8398, for instance, is usually parked in front of the Kaieteur News head office on Saffon Street, Charlestown, while PRR 8399 is often seen on Regent Street, in the heart of the city, near Bhena’s Footwear, the shoe business operated by Lall’s wife.


The Brijnanans successfully obtained import duty concessions in the sum of $4,222,223.55 for each vehicle, totalling in excess of $8M. Meanwhile, this newspaper’s research into the source price for a Lexus L570 is about US$80,000. Import duty for such a vehicle would be a total of US$94,500, bringing the total value of the vehicle to US$174,500, or more than G$36M for each of the vehicles imported by the Brijnanans.


If the alleged violations are upheld, it would mean that the Government was cheated out of a total of US$189,000, or almost $40M in import duty for the two vehicles.


At the end of August, after an hours-long standoff between GRA officials and the Brijnanans’ son, Sankar, a high-ranking GRA employee, the vehicles were handed over to GRA and impounded at the authority’s warehouse.


An investigation was then launched to ensure that procedures and policy, as well as the provisions of the law, were adhered to. The criminal charges, this newspaper understands, stem from that investigation.

The PPP has demonstrated that the dictatorship is willing to use powers of the state to victimize citizens this is another example similar to the Arjoon case at NBS where Jagdeo and the dictatorship is willing to persecute innocent citizens for their own narrow agenda to dominate and punish Guyanese citizens.

Ombudsman’s report on NBS fraud charges delivered to National Assembly

The National Assembly has been supplied with copies of a critical nbs 9report compiled by the Office of the Ombudsman on criminal charges filed by police in 2007 against three senior managers of the New Building Society (NBS).
According to a statement from the office of Ombudsman, Justice Winston Moore, the copies of the report are for the purpose of laying them before the National Assembly.
“I have also decided to publish the report in the public interest. My decision to do so at this time is partly influenced by publication of erroneous statements made about findings supposedly made by me in the said report. I trust that the persons concerned and interested members of the public will now read the report and see for themselves what I have written,” the statement said.

Dr. Ramsammy refuses to clear his name from allegations

Now that self-confessed drug lord, Roger Khan has gone to jail in the United States, Guyana’s Minister of Health, Dr. Leslie Ramsammy, does not see the need to visit the police station and clear his name from the many allegations leveled against him.
At a press conference yesterday at his office in Brickdam, Minister Ramsammy told reporters he did not commit any crime, and as such does not see the need to clear his name.
“The police are doing their work…I don’t have any reasons to go clear my name…am I going to go to people and say that maybe I committed a crime, y’all want to check? I didn’t do nothing. So what’s the point?” the Health Minister questioned.
Dr. Ramsammy got pretty ‘worked up’ when a reporter informed him that the allegations leveled against him are of a criminal nature. He noted that allegations such as these occur on daily basis.
“Everyday the people you work with, you hear things about them of a criminal nature. I could tell y’all that I was never seen with those people (Roger Khan and his associates)…some of y’all bosses were seen with them…so y’all want to talk about that and investigate it? Y’all want me to show you pictures of these people?” the Health Minister said.
Dr. Ramsammy also debunked rumours that he is wanted by the US authorities. “And all these nonsense that the Americans want me…god damn it!! Is every other week I am in America…you ain’t think if they want me, they will get me?”
The Health Minister added that he has nothing to worry about and will only focus on serving the people of Guyana.
He challenged the media to interview the people who suffered in Guyana at the hands of criminals. At the same time also, he accused the media fraternity for not writing about or investigating political leaders who were seen meeting criminals in Buxton.
“For political leaders and other people, tapes were being played and nobody investigated and nobody called for an investigation. All I’m saying is, the same focus y’all put on some stories, put it on all stories.”
Minister Ramsammy reiterated that he has no problem if the police want to investigate him, as long as they have their facts right.
“Some of the people out there screaming…they got more to worry about than me and all those people staying away from parliament because of this…people elected them to do a job. They should be there doing their job and leave the police to do its (sic) work.”
Since the commencement of the Robert Simels trial (former lawyer for Shaheed Roger Khan), Minister of Health, Dr. Leslie Ramsammy’s name has been mentioned by the star witness, Selwyn Vaughn, as acting on behalf of the Guyana Government in providing assistance to the self confessed drug lord, Roger Khan.
Dr Ramsammy has constantly denied the allegations leveled against him. At one time during the trial, Kaieteur News had quoted the Co-founder and director of the firm that manufactures the equipment, Pert Meyers, as saying that Minister Ramsammy purchased the spy equipment.
During the course of Simels’ trial, Peter Myers told the US Federal Court in Brooklyn under oath that the intercept equipment is only sold to Governments and one set of equipment was sold by the company’s Florida sales office through the Spy Shop in Florida to the Guyana Government.
Myers identified the equipment as an intercept receiver and two laptops that were sold to the Guyana Government.
Meyers also identified Dr. Leslie Ramsammy as the purchaser of the equipment.
Defence attorney Gerald Shargel stated that the evidence shows Dr. Leslie Ramsammy authorised the purchase on behalf of the Government of Guyana.
Later in the trial, a letter surfaced bearing the letter head of the Ministry of Health with Minister Ramsammy’s signature for the purchase of the spy equipment. Ramsammy also denied ever penning the letter.
