JUSTICE Franklin Holder said he left the bench last week Thursday during the Carvil Duncan trial because of an alleged statement made by Attorney General, Basil Williams, which is: “I could say what I want to say and however I want to say it, I have always been like that.”
“Immediately after hearing these words, I rose from the Bench and went into my Chambers. I did not adjourn the matter, nor did I give any instructions to the parties,” Justice Holder mentioned in a letter of complaint addressed to Chancellor of the Judiciary (ag), Yonette Cummings-Edwards, which was seen by this newspaper.
His letter made no mention of any “threat”, and although he referenced Williams’ statement about a dead magistrate, Justice Holder made no specific complaint about it nor did he describe it as a threat.

People’s Progressive Party MP, Anil Nandlall had made the allegations that Williams had threatened to kill the judge- a claim which Williams has denied. During a news conference last Friday Williams in detailing what transpired said that he was cross-examining Duncan, who is being represented by Nandlall, and the latter kept interrupting the court. Williams, SC said that when the Judge announced that he was about to adjourn the matter, he (Williams) made a request to ask a final question, which he was permitted to do. The AG said that after he had asked his final question to the confidential secretary of Duncan, since she was the one being cross-examined, he thanked her and proceeded to his seat.

Ex abundanti cautela

He then stated that: “When I was about to sit, I saw the Judge was about to leave and I said ex abundanti cautela; out of excessive caution could I enquire the answer ‘no’ was recorded. The Judge, to my surprise said, Mr. Williams you’re not in-charge of my court.” The AG related that the Judge then said that he interprets what Williams said to mean that he (the Judge) did not record a previous answer given by the witness, and that he (the Judge) takes great umbrage to that.

Williams, SC said he then shared an experience which happened years ago, where a magistrate presiding over a matter he was involved in had interpreted something he said, differently. He said that since then he has been “particular” about what he says in court and “incidentally, that magistrate is dead now”.
He noted that after this, he continued his conversation with Justice Holder, after which Nandlall “jumped in as though he was under the influence of something” and the Judge left the benches. The AG said that his view is that the Judge had intended to leave but he (Williams) had detained him by asking another question. He said that no date was given by the Judge for a continuation of the hearing, as he has the option of sending notices to counsel about new dates.
Judy Stuart- Adonis, Senior Legal Advisor, who was in court during the incident, in a statement seen by this newspaper said the AG was insistent in the inconsistencies of the witness being recorded, after which he subsequently referenced a former Magistrate, who also misconstrued him and that Magistrate is now deceased, meaning he/she is no longer a sitting Magistrate. Esther Sam, Principal Legal Adviser at the AG chambers also gave a similar account.

Meanwhile, in light of the accusations against him that he threatened to kill the judge, the AG on Friday had warned that he will take legal actions against the media houses that repeated the allegations by Nandlall. “I practiced law for 33 years and no allegations have been made against me in the practice of my profession. Newspapers have come out and I shall be taking actions against those newspapers” he told reporters.
The AG said that he will be taking actions because several weeks ago he warned that it was no longer “free day” on his name, as he would not permit anyone to filch his “good name”.
“I have never done acts of corruption” AG Williams maintained.
He went on to state that the accusation by Nandlall, who is a former AG, “reeks of crass disrespect” and is an “assault on the government,” since he (Williams) is a government minister. “I gave warning. I am not going to allow people to attack me and my office. It is an assault on the government. We have to ensure people’s reputation are protected” the AG said, confirming that legal actions will also be taken against Nandlall.

There is no doubt AG,Basil Williams SC "was out of order" in court,he should be penalized.

The two honorable gentlemen former AG,A.Nandalall and current AG,B.Williams are at each others throat for a while,Mr.Nanadalall heard the word "Magistrate dead"and construed it was a threat to the honorable Justice Holder.

The same day Anil posted on his face book page Williams made"death threat" to Justice Holder,some of the media picked it up and published the next day,I made a post on GNI that day,the rest is known from press conferences held by both gentleman.

Anil wants to score cheap political points in a mischievous way,

"Mischief Maker Anil Nandlall" stands.

Basil Williams is a ■ peg in a O hole. His performance as AG has been marked by one blunder after another. President Granger could do with a competent replacement for that nincompoop.

It does look like a threat as it was unnecessary to bring up that the magistrate is now dead. Lawyers always mean to say everything they say. There is no context for bringing up that the magistrate is now dead.

Django, it is obvious that there is more to this story. Williams also lied.  In his interview, Williams did not indicate that he told the justice that he could say what he wants where he wants. He portrayed himself as the epitome of legal propriety.

I guess we, including me, have to be careful checking the authenticity of what is said in the media. This is a item from the chronicle, so I suspect that there is some spin to it also.

Look at this saga in colour, Justice Holder is a dam Blackman, after a phone call from maybe Harmon,or Granger he change his story, so the next day what do you expect him to say.Either way he was  threatened but as a PNC he had to take their side and the Attorney General is the BOSS.

Justice Franklin Holder has given a statement pertaining to the conduct of Attorney-General Basil Williams SC in his courtroom last week, according to acting Chancellor Yonette Cummings-Edwards, who yesterday said that the judiciary would pronounce on the issue soon.

“I am in receipt of information in relation to that matter and the matter is currently being address-ed,” Justice Cummings-Edwards told reporters shortly after her swearing-in yesterday.

“An official report will be given to the press as soon everything is completed… within a matter of days,” she added.

The now acting Chancellor explained that she was briefed on the matter in her capacity as acting Chief Justice.

All of the judges of the Supreme Court attended a meeting last Friday morning for about half an hour but no statement was made.

Stabroek News was told that the Williams issue was discussed and it was following this meeting that a unanimous decision was taken to write to President David Granger on the matter.

The Attorney General was accused by his predecessor, attorney Anil Nandlall, of threatening Justice Holder last Thursday, during a hearing involving suspended Chairman of the Public Service Commission Carvil Duncan.

But Williams denied that he threatened the judge and announced that he would take legal action over the claim and reportage on it. He specifically said that his lawyers were preparing to write letters to the two newspapers that published the allegations without speaking to him.

Observers have, however, noted that even in his own rendering of the events of the day in question, Williams’ words did not comport with what was expected from the Attorney General, Minister of Legal Affairs and the Leader of the Bar.

Williams told a press conference on Friday that when Justice Holder indicated that he was going to adjourn the matter, he asked whether he could be permitted to ask Duncan’s confidential secretary one final question.

He was permitted to do so. According to Williams, after noticing that the judge was about to leave the bench, he enquired whether the answer to the last question was recorded. “The judge to my surprise said, ‘Mr Williams you are not in charge of my court.’ And I said, ‘No sir’ …but the judge then said to me ‘Mr Williams I interpret what you are saying to mean that I deliberately did not record the answer that was given by the witness previously and I take great umbrage at that.’ And I said, ‘Sir, surely that is not on your record, because I never said anything to that effect or intended anything like that,’” he explained.

Williams recalled that he told the judge that his comments reminded him of a similar allegation made against him by a magistrate several years ago.

“He [the magistrate] cited me for contempt and the rest is history. And I said that since then I have always been very particular about what I say to the courts and to be precise so that nothing else like that could return and I said coincidentally that magistrate is dead now and I moved on,” he said.

Nandlall said the judge subsequently left the bench without adjourning the proceedings or setting a date for continuation.

This implies support for APNU+AFC. Also, the editorializing titles of your threads clearly show your bias against the PPP. So be it, as you say.

I am striving towards an independent outlook. This means that I reserve the right to lash both APNU+AFC and PPP on some of their actions. I shall let readers judge whether I am succeeding. Their feedback, positive or negative, will be received with respect and appreciation.

I never knew the "Fifth Estate" are dissallowed from using materials from the "Fourth Estate" for discussions,or for that matter present their view for discussion.

Have you condemned his lie, the discrepancy between what he said on his interview and what was reportedly said by the judge? That was the main gist of what I said regarding your post.

The Judge indicated that the incident stemmed from the Attorney General being loud in the courtroom while questioning him about whether he had recorded a statement from the witness who was on the stand during an ongoing hearing.

While not committing to offering an apology, as requested by Justice Franklin Holder, Attorney General Basil Williams SC., has indicated that he is not “unprepared” to work with the Judge to “resolve what was a fleeting engagement after the business of the day was completed”.

In a letter to Acting Chancellor of the Judiciary, Justice Holder indicated that he wanted an apology from the Attorney General over his behaviour in his courtroom last week.

The Judge indicated that the incident stemmed from the Attorney General being loud in the courtroom while questioning him about whether he had recorded a statement from the witness who was on the stand during an ongoing hearing.

The Judge in his letter made no mention of ever being threatened or feeling threatened by the Attorney General, as was claimed by Former Attorney General, Anil Nandlall, and the opposition People’s Progressive Party.

He stated that Mr. Williams did make mention of a former Magistrate who has since died and the fact that the Magistrate was the last person who told him what he could and could not say.

However, the Judge did admit to leaving the bench without adjourning the court or giving directions to the parties involved.

Attorney General Williams, believes the statement by the Judge vindicates his position that he had never issued any death threat against the Judge. In a statement today, Mr. Williams thanked the Judge for doing the “right thing and exposing the iniquity of Nandlall”.

When questioned today at his Chambers on whether he would be prepared to give in to the Judge’s demand for an apology, the Attorney General said that will be dealt with if and when the time comes.

“We will discuss it, because you notice that it was Nandlall who caused the problem for three hours and the engagement with the Learned Judge and myself was merely three minutes”.

The Attorney General has already instructed his Attorneys to dispatch letters to Mr. Nandlall and the media houses that reported on his “libelous” statement that a death threat was made against the Judge. Senior Counsel Williams is convinced that the entire furore is part of a plan by the People’s Progressive Party to get to him and obstruct the work of the Court that is dealing with matters involving decisions that were made by the PPP administration.

Basil Williams is a disgrace to APNU/AFC,this schmuck thinks this is the Burnhamite era,then on top of it Granger made him Senior Council,power flew to his head.

Let us see what action Granger will take against him.

Sometimes information can be processed differently.

I haven't had any difficulty accepting Williams, tried to coverup his reckless behavior and for that he should be penalized,he holds a high office and should act accordingly.

I have seen him in Parliamentary debates,in my view his demeanor is authoritarian.
